In October 2004 I went to my local T-Mobile store to buy a new phone because my charger no longer worked. At this point I'd been with T-Mobile for well over a year and a half, had no contract and was paying month to month (exactly what I wanted).

In december 2004 I changed jobs where my new employer would be paying for my phone. I called to move my number and T mobile said I started a new one year contract when I bought, or TMobiles term, UPGRADED. They said I agreed to a verbal contract. As I mentioned above, by design, I was not under any contract with T Mobile, yet now by some magic verbal contract I am now being hounded to pay 230.00 for cancelling a contract I never even knew existed.

I've have been a loyal T Mobile customer paying $70+/month for close to two years, but you do not care. They said there is a $200 fee to end my contract early. This is simply not right and is very deceptive. Thank you for your help.

Michael, I'm sorry to hear that you have had some trouble. Do you still have your original receipt from october '04? When a customer upgrades their phone at a T-Mobile retail store, they can extend the contract or not. There is an incentive to extend because you will get the phone for a lower price, be it through an instant discount or a mail in rebate. If you did somehow extend your contract when you went into the T-Mobile retail store for an upgrade, it would say so on your receipt. Duplicate reciepts of upgrades are kept by the retail store. Verbal agreements to extend your contract do not have a paper receipt. It is exactly what it sounds like: a verbal agreement. Verbal agreements to contract extensions usually occur over the phone. Obviously there is no paper to sign when you talk to someone over the phone but verbal agreements can also occur in store. The most common reasons for a verbal agreement to a contract extension include: Ordering an upgrade to be shipped to your house Switching your current rate plan to a promotional rate plan Getting MORE minutes for the same price you are paying now Receiving the same amount of minutes for a LOWER price than what you are paying now Though rare, it is possible to swith your rate plan to a non-promotional rate plan and still extend your contract. Please respond if you would like for me to explain how. For now, I really hope you find that receipt, it will definately let you know if you extended for a year or not due to the upgrade. If you can't find the reciept, then try to find out on what day you did the upgrade. Go back to your T-Mobile retail store, and ask to see a copy of the receipt. Tell them it should be in with the paperwork for the day you did the upgrade (give them the date). Legal documents must be kept for a certain period of time and there should be a duplicate copy of your reciept available. Don't be surprised if they don't have a copy of your reciept available on hand. Size limitations may cause them to take all their paperwork to a different T-Mobile store with more space. However, there should still be a copy. Also, don't expect them to re-print the reciept on the computer, because they cannot. Only reciepts from the past 60 days can be re-printed.
