Tell us has your experience with this business or person been good? What's this?
This company promised web page views for a fee. The company committed to 35,000 page views, but delivered zero. The company was unresponsive in addressing the issue, referred to a contract that committed to delivering such views, and maintained that exceptions in the contract was the reason that no views were recorded - something that based on their contract was plainly not plausable.

The company ripped us off, with no cure. This is being followed up with the BBB, and will be noted online for failure to deliver services as represented.

Tazmania Advertising vs. Customer Jim

#2Consumer Suggestion

Thu, January 18, 2007

I have to agree with julie there. How can tazmania resolve this issue with customer when customer failed to provide his full name. There are alot of people by the same name. Jim who? So yes andra never used jims last name because she does not slander people. Jim on the other hand should not use the full name of person since he is slandering. Whether its true or not. Just like the company responded. It does not need to be true or false. Slander is slander. And the poor girl is being slandered. You could at least put taz or something. You did not need to do that jim. Just a word of thought. Who is to say that jim did contact the company. How did he contact them . Through email or through phone. I called the company up and they returned my phone call. Jim i think you should of contacted through phone. Sometimes people fail to do so . And there was a lack of communication. I guess only courts can figure this out through phone records and email records. anyways. good luck tazmania advertising

Andra would have better served her business if she kept her mouth shut. Her hostile responses DO speak volumes about the kind of public presence this company wishes to project, which is pretty doggone scary. I shudder to think what the customer service personnel are like if this how the company approves a response in a public forum. On the phone, with no one listening - eek. Reading a negative report about a company may make me stop and think, but that alone will not mark the company as ?unethical? or to be stayed away from. Reading responses like Andra's - THAT will make me say ?bad business?. Using a customer's name on a public forum, when that customer didn't present their last name themselves - should be legal repercussions FOR THAT. And yes, truth is an absolute defense to libel or slander.

Why couldn't you

Why couldn't you just answer the emails so this guy has documentation that he apparently would like? Why the sidestepping the whole issue with a diatribe on libel and slander? It's not libel/slander if true. As he said earlier, your childish responses speak volumes. Answer his emails or explain why this is allegedly not appropriate for you to do. Personally, he should now send a certified, signed receipt required letter asking for explanations. Any alleged phone call will most definitely be twisted at this point.

This is very ridiculous

#5REBUTTAL Owner of company

Jim. Again if you would of come onboard or dialed our number listed on our website in which we are not hiding like other companies. We would of indeed answered your phone call and addressed your issue, instead you made a ridiculous accusation and slandered our company. Please do not reply anymore Jim Do you know what libel or slander means Jim? Obviously not, because you wouldn't be harassing us like you do. Why is it that people find it easy to threaten companies on the internet than those who are non-internet retailers.? Hmmm, i bet if we were face to face Jim you would not write or accuse us of such a ridiculous claim you say. You have received half our services and we have to report losses and write it off this tax season ... It is people like you that most internet businesses fail. Let give you Jim the definition of liberl/slander: Who can sue for libel or slander? Individuals, companies, firms, charities and trade unions can all bring proceedings for libel and slander. Governmental bodies (local authorities, central government bodies) and political parties cannot - but if the allegation reflects on them, individual councillors, civil servants and politicians can all bring actions in their own name. Q4 What must a person or company prove in a libel or slander action? When an individual or company brings a libel or slander action, they must show: 1. that the words are defamatory of them; 2. that the words would be understood to refer to them by even one other person; and 3. that the words have been published to a third party. A libel claimant does not have to prove that the words are false or to prove that he has in fact suffered any loss. Damage is presumed. A slander claimant will need to prove that the defamatory allegations caused actual damage, unless the slander is within certain categories. Q5 When are words defamatory? There is no set definition of 'defamatory'. A statement may be considered to be defamatory if it tends to do any one of the following: 1. lower the claimant in the estimation of right-thinking members of society generally; 2. disparage a claimant in his business, trade, office or profession; 3. expose the claimant to hatred, ridicule or contempt; or 4. cause the claimant to be shunned or avoided. Whether or not a statement has that effect is measured against the standard of the reasonable man generally and not a limited class of people who may have different standards from the majority of members of society. Common examples of what may be considered defamatory are allegations that suggest a person is: Immoral Dishonest Corrupt Insolvent or in financial difficulties Incompetent The producer of shoddy goods Now you do you get it Jim? So yes you are going to wait for our lawyer to contact yours. Oh by the way do you have one? Don't worry this is the last of our posting on this forum and you will wait for a phone call. Bye jim. Sorry, we contacted Transmaina several times by email, notifying them of no service, requesting assistance, and receiving immature responses such as seen here - which speaks for itself - and no cure. We await their counsels notification, which of course will not happen based on the facts.......
