Just read the dates, this employee doesent even have knowledge of this incident. The charge went through on 17 July and they say 20 july. One would think someone with any creditability would have atleast checked!

Our lease agreement includes a "smell of cigarette smoke" clause which all residents specifically initial next to as well as signing the entire lease agreement. In addition, the "smell of smoke" clause appears on each and every monthly invoice residents receive to remind them and the residents sign these invoices as well. The clause states that "NO SMOKING: $1,000 deodorizing fee is smell of smoke is noticable in home." There is no clause in the lease which states burns, ashes, or stained walls are required for the clause to apply. In over 5 years in business, this is only the second time we have charged a resident under the "smell of smoke" clause. We do not want to collect on this clause. We just want to protect our property and future residents from the discomfort of smelling smoke in their home. Non-smokers know the smell of smoke can linger for a long time. On/about 20 July 2009, one of our maintenance staff entered the home in question in response to a maintenance issue. Maintenance noted the strong smell of smoke in the home and an ashtray full of cigarette butts on the end table in the living room. Maintenance took a photo of the ashtray and reported the incident to the Front Desk. To remove the smell of smoke for future non-smoking residents, we have to send all linens, bed spreads, towels, and drapes out to be cleaned. We have all the upholstery, mattresses, and carpets steamed cleaned. We throw out the pillows and permanent air filter. We have the air ducts professionally cleaned. We have to wash down the walls, cabinets, and countertops. We then have to rent an ozone machine and let it run for 24 hours to kill any remaining odor. All of this costs over $700. In addition, it takes almost a week to complete this work so we loose a week's worth of rental revenue. Since the smell of smoke was noticeable and there was an ashtray full of cigarette butts in the home, the Front Desk charged the resident $1000 in accordance with the lease agreement.
