On 7/26/05, I received the following e-mailf rom Ebay: Hello, We have received your Fraud Protection Claim for Item #4547735722. Your claim has been assigned the Claim Number 447066. We are sorry to hear that you were unable to resolve this transaction with [email protected]. I have reviewed your claim and regret to inform you that your claim has been denied due to alterations and or repairs having been made to the item after it was received. In order to be eligible for coverage the item must remain in the condition that it was received. For further clarification about eBay's Standard Purchase Protection Program, please go to the URL below: http://pages.ebay.com/help/tp/esppp-coverage-eligibility.html Under the section 'Not Eligible' is the following: 'Merchandise that has been altered, repaired, discarded or resold.' I am sorry we could not be of more assistance. I also supplied you with proof that indicated that I brought the truck in for repairs almost immediately after I received it. Whether or not the seller is liable for misrepresenting the condition of the truck has nothing to do with whether or not the truck has been repaired. If you read his auction description, you would have seen that he stated that truck need "nothing mechanically", which was not true. The transmission was bad. I HAD TO FIX the truck or else it would have been 3 months now since I bought it and would have been without its use. What was I supposed to have done, rent a car for the last three months ? Your guarantees are worthless, just as your service is. I'll NEVER buy another car through Ebay again. EVER !!! You suck.

Finally go the truck back from the transmission shop and the cost was 2,994.78. Works fine and I got a 2-year warranty. The BBB in Houston said they couldn't help me beacuse I bought the truck "as-is", so I guess that a dealer can make all kinds of guarantees and is not bound by them as long as he sells a vehicle "as-is". I also filed a complaint with the Texas AG's office and I quit Ebay as a result of this ripoff. But I didn't quit before I let them know what I thought of their service. Ebay gets fees from sellers (not buyers) and that's how they make their money. So, all they care about is the sellers. No sellers, no profit. The buyers can go to hell as far as their concerned, so be careful when buying anything through Ebay. You get what they send you, no guarantees. Of course they responded that they were looking into my complaint, but that was two weeks after I filed it. I doubt anything will come of it, since this dealer posts a lot of auctions and thus spends a lot of money on Ebay. We'll see.

Regards, Customer Support (Trust and Safety Department) eBay Inc To which I answered: I recently received a notice from you folks that a complaint was issued against me for misusing the contact member e-mail system, which I used to warn bidders of auctions of Texas Direct Auto, who ripped me off for about three grand in an auction that I won for a truck. I don't like being taken for thousands by unscupulous characters such as Texas Direct. I don't like it that Ebay has done NOTHING in this regard to protect me, despite all kinds of advertised safeguards against such fraud. I will persue this matter in the legal realm and I am requesting that you terminate my ebay account immediately for I have no desire to do business with you or through you. Thank you, Gilbert Jesus. I have filed a complaint with the Better Business Bureau in Houston against Texas Direct Auto. If Ebay does not terminate my membership as requested, I will continue to e-mail unsuspecting bidders until they do.

Therefore, I had no choice but to take the complaint to next level. The seller cannot deny that as of Tuesday, May 31st, four days after receiving it, there was a problem with the truck. The sellers contention that I had somehow damaged the transmission myself is a theory not based on any fact. Although he seems bent on putting the blame on me, I'm 52 years old, I don't hot rod around, I'm a mechanic who has worked on cars for 40 years and loves his show cars and takes great care of his equipment. The truck I bought is a heavy-duty truck, a 1-ton crew cab dually 4x4 built to pull in excess of 20,000 lbs. These trucks don't break due to work. I've had them (454 crew cabs) before and they last a long time. The seller's contention that this truck was broken just FOUR DAYS after receiving it in such excellent mechanical condition is tantamount to an admission that there was a defect with it before it was sold. I spent 15,000.00 (Buy it Now) for a truck that "needs nothing mechanical" but is sitting in the shop right now awaiting a $ 3,000.00 transmission rebuild
