Tell us has your experience with this business or person been good? What's this?

This business will happily take your money, but when an issue arrises, they will dodge phone calls and any other form of correspondence.  After months of attempting to reach the man in charge of financial affairs who had personally made an agreement with me, I filed a BBB complaint at which time I was immediately contacted and threatened.  He also pointed out that my argument would not hold up because I signed a contract.  As there was no paper trail documenting our verbal agreement, my hands were tied.  I provided photos and medical records outlining a severe, extenuating circumstance in which I am wheelchair bound, immunosuppressed, on a feeding tube and cared for in my home by a home health nurse.  For this reason I had to refrain from working with the cosmetics company I was to represent at The Ultimate Women's Expo.  If honoring women and helping them find their inner and outer beauty is their mission, they have failed on two accounts.  First, if this is how they handle business, by making empty promises and not doing what would be considered by most as "the right thing," then these values are not instilled within their own company.  Second, kicking women when they are down, certainly doesn't convey a firm belief in their values.

Here is the correspondence cut and pasted from my saved emails:

Hello Mr. Gruber,

I am submitting this information in a very unprofessional manner due to the urgency in which it is needed and my lack of mobility.  I recently had a kidney transplant at --------------------------------------------------.  I am consistently in the hospital due to kidney rejection and my immune suppressed system makes me more susceptible to illness.  So at the moment I am bed ridden or upright in a wheelchair.  The secondary issue is  my inability to keep foods, liquids, and most importantly my anti-rejection medications down.  For this reason I am receiving home health through Ally and receive anti-nausea medications IV through a PICC line.  I was actually prescribed a bed that can sit upward at a 45 degree angle when I sleep so I can take advantage of gravity for better motility.  Lastly, I am in a non-weight bearing state because I was forming hammer toes on my left foot and as a result, ulcers were forming on my feet and were a great concern to my team of doctors because those ulcers could very easily result in osteomylitus (bone infection), in which I would not be able to fight off due to my suppressed immune system.  All these issues surfaced one after the other and quite rapidly.  Here are some photographs and please feel free to contact any entity listed below for verification, as I have given permission for the release of my medical records.

This is my foot, Being cared for by ------------- — pins are scheduled to be removed in 2 weeks, non weight bearing until next appointment.

Receiving Home Health Care through Ally infusions to receive nutrition and interjection medications.  IVEDCO is the supplier of these medicationsPICC line shown below:

Here are doctor’s notes and they aren’t clear, however you can call my Nephrologist if needed, I have informed their office that you may be calling for information.  I’m not sure what exactly you are looking for here, so I gathered everything in reach hoping that it would be sufficient.

I do hope this is sufficient.

I also would like to give you a brief summary of the conversation I had with a representative about 2 weeks ago.  I spoke with a young man whose name I do not recall, he told me that it looks as if  there was an attempt to refund the $600 payment I had made under much better circumstances.  He continued to tell me that it appears as if thhre bank did not accept there refund because there was no such account.  I said yes, exactly, I closed that account due to many fraudulent charges.  I asked if I could give him a different bank account and he said that refunds can only be made back to the account it originated from and that a check would be sent out.  He then verified my address.  Today when I called to follow-up, I was told that refunds are never issued.  My body may be falling apart, but I am of sound mind and something is not right.  Please consider the mountains of medical bills we are treading to in order to keep  current .and in good standing, and how great of an impact that small amount of $600 would be for us.

Please let me know if you need something more specific, or a contact number (they are all in there somewhere, but I realize it is a lot to sift through.), or if you have questions.

Hello Mr. Gruber,
I am following-up in regards to our correspondence on April 9th.  Per our phone conversation, I was told that I would be receiving a refund check via mail for the original deposit of $600 within 7-10 business days and to expect an email outlining this agreement.  As of today, April 17th of 2015, I have not received either.  For my records, will you please confirm this agreement with a response to this email?  Your time is greatly appreciated.

Regards,

Dear Mr. Gruber,
I have been in contact with your office on a weekly basis in regards to the $600 refund you agreed to on March 9th.  Each attempt to reach you via phone, I was told that you were out-of-the-office and to try again the following week.  I would do so and the cycle would repeat itself.  “Lauren” was quite helpful when she informed me that the check was mailed out the previous Thursday.  After 2 weeks had passed I called to inform the accounting department that I never received the check, I was told to give it an additional week.  Again nothing.  The young lady I spoke with after waiting over one month for the check to arrive, assured me that another check would be cut.  I requested that it be sent certified mail and that I receive a phone call after the check was mailed.  She confirmed my address and phone number.  I never received a call…or a check.
I am fully aware that I signed a contract July 2, 2014.  At that time I was  healthy and eager to participate in this event.   Unfortunately, there was an unexpected, sharp decline in my health.  I needed to dissolve my team and no longer be a representative for my company.  When I called about possibly getting a refund, you were very understanding and your words exactly were,”We’re not jerks here, and I will put in for a check to be issued.  It will take 7-10 days to process.”
Would you please make good on our verbal agreement and respond to this email?  You are appreciated.
Regards,

Casey,

I was out of the office traveling, as per my voicemail.  It is more than unfortunate that you contacted and made a complaint to the BBB, especially considering the terms of your Contractual Agreement.   We are proud of our 17 year reputation and take every measure to protect the integrity of our nationally produced events.   At this point you have forced me to respond directly to the BBB with the facts of this case, as per the terms of your signed contractual agreement.  We will not respond directly to you again.  Further, we are sending a copy of the signed Contract directly to the BBB.  We are also sending a copy of your Contract to ----------, so they can take whatever steps they deem necessary to insure that their representatives can continue to exhibit in our Expos.

Mr. Gruber,

I am sorry that you were not willing to resolve this issue and hold up your promise to me.  It is a very bad reflection on The Ultimate Women’s Expo as a business.  I was not seeking a refund because I decided this wasn’t something I wanted to do, because there was nothing I would have wanted more than to have the physical ability to work this show.  I haven’t the energy to devote to this any longer and I do hope that you have considered how the amount of $600 would have been of great help to my family to offset extensive medical expenses.   Here os my final response to the BBB:  (Please see beginning of this report to review the final response.)
