In November, 2007 we leased a house from Third Coast Investments, LLC, and we have since moved. Since that time, Third Coast Investments, LLC has refused to return our security deposit and the payment for utilities (as per our lease agreement).

We have to sued Third Coast Investments, LLC and Jephery Burnett (the owner of Third Coast Investments) in JP court for the return of the security deposit and payment of utilities and we were awarded the judgment. Jephery Burnett and Third Coast Investments, LLC have yet to pay the monies that are owed to us. In fact, we have recorded an Abstract of Judgment with the county.

Jephery Burnett also is the owner of JB Contractors & Development, LLC.

In reference to Jeph's claims:

The judge stated that there was enough evidence to go to trial. The judge stated that everything should remain "status quo" at that time until all the evidence was heard in court. Jeph was supposed to purchase ALL necessary insurance on the house as well as bring the 2nd mortgage out of arrears by September 11. It wasn't until September 28th that the insurance inspectors came out to look at the house, which was clearly in violation of the court order. Also, he never paid a dime on the 2nd mortgage. The case was finally heard and the judge denied all relief requested by Jeph (judgment attached).

The judge never did rule that the home should be rented or the locks changed. That is a fact, and can be confirmed by calling the 412th District Court of Brazoria County.

We never caused any damage to the home and again have several witnesses to prove it. We have fixed several faulty plumbing and electrical issues while living at the house and perhaps that is what Jephery is referring to as the way the kitchen was wired, the hood vent to the stove caught on fire.

We have never misrepresented anything of the settlement of cases, all are a matter of public record and we have just posted verbatim what they state. You can view his history at:(((Redacted)))

Finally, this complaint isn't about all of this stuff above, it is about the fact that Jeph owes us our deposit and the utilities. He has yet to pay (judgment attached).

I did in fact purchase the home from the owners. Owner finance.
Owners did not pay the taxes and would not get insurance as agreed.

The judge did state that I had ownership rights to the home and ordered that insurance was placed on the home. I purchased a policy and it was then canceled due to the tenants not allowing the insurance inspector to view the property. (in violation of a court order)

After an abundance of false claims of fraud and other legal issues brought on my the tenants, lender (individual acting as lender) it was fiscally responsible to walk from the home.

I have photos of the home after I spent the money to remodel it before they moved in and pictures of the damage after they moved out.

The Judge did in fact order for the home to be rented out immediately after the Archers moved out and was the reason for changing the locks.

Mark received a ticket for a assault by threat because of threatening to "bash my skull in" that is documented and witnessed by a Alvin police officer who was present.
I don't believe that violence is the solution for any situation but clearly this view is not shared by Mark or his wife (vicki) Archer.

As far as bad mouthing. I have never denied that I have been sued. I have not however been sued for taking money I didn't earn. The details and settlement of cases I have been involved in have been misrepresented by the Archers.

Vicki does know contractors (her husband Mark is one) i.e. I am competition for his company.

While we rented the house from Jeph Burnett, he had "permission to sublease" from the owner that expired 1 month prior to the lease agreement he had with us, thereby making our lease agreement with him null and void.

In addition, the lender exercised his rights to collect rent as per the Deed of Trust on the property. This was namely due to the fact that there was no insurance policy on the house and the taxes were 2 years in arrears. In addition, the mortgage payments were not made in a timely manner. As a result of these issues, the house was in jeopardy of being foreclosed on.

We received notification to begin paying our rent payment to the lender in June, and we did. However, Jeph tried to evict us (even though the lender sent him the same notice as well), and he took us to court for eviction proceedings. The evicition case was dismissed (the judge saw no need for us to be evicted).

Our demand for deposit was due to the fact that our lease with him had become null and void and we wanted our money back.

We never caused any damage to the house, and have many witnesses to prove it, including the owner and lender of the house.

In addition, Jeph never had permission to change the locks on the house after we moved out. The judge actually stated that he would not rule whether Jeph could change the locks and get it ready to rent. The matter would be something between Jeph and the owner of the house (which they NEVER discussed).

Mark did get a ticket for Assault by Threat, but Jeph had to run away screaming "help me, help me" like a big sissy. Mark never threatened bodily harm.

Jeph states that we "bad mouthed" him, that in fact is false... all we have done is speak the truth to alert consumers to his business practices, which are all a matter of public record. He claims that being sued is normal for a contractor, however, I know dozens of contractors that have been in business longer than Jephery and have not been taken to court once, and they pay their taxes and subs too.

Mark and Vicki Archer did rent a home from me.
They did pay rent as agreed for the first 12 months.
They did not pay the last 6 months as agreed.
They did Demand payment of their deposit even though they hadn't moved out.
They did cause thousands of dollars of damage to the home and even kicked in the back door of the home once the judge told me to change the locks after they had moved out.
Mark Archer did plead no contest to Assault by threat towards me after attempting to start a fight with me infront of my home, my children and a Alvin Police officer.
Mark Archer has spent every moment of his free time (a lot since he does not work) bad mouthing me to anyone who will listen. Mostly via the internet.
I do own a successful contracting business for 13yrs and have a B rating with the BBB in Houston (I am not a member of the BBB so that is saying a lot)
I am registered with the TRCC and have had no complaints ever on there.
I have been sued but that goes with the territory of being involved with 1000's of contracts over the years. I am a contractor after all.
I almost always go to mediation and almost always resolve any issues with a win-win for all parties involved.
