On August 8th 2013, a representative from superior systems inc based in Arvada CO came knocking on my door selling a Kirby vacuum. I gladly let him show how the vacuum worked and took it into consideration. I told them I would have to run it by the husband before I decided to do anything. He told me about the part of the contract that stated I had a 3 day grace period to decide to cancel with no penalty. 

On day 3 I mailed in my cancellation exactly as the contract said to do. I Called the credit company to let them know I had mailed in the cancellation. 4 days later, I spoke with the credicompliant again to reassure them that I had cancelled this contract and was waiting for superior systems to come pick up the vacuum. I called superior systems, just to make sure they received the cancellation and never got a call back. So I assumed they did, and slept waiting for them to come pick up the  vacuum. 

In the contract, it stated that if superior systems fails to come pick up the product, it is mine free of charge. So 30 days passed and they still hadn't collected the vacuum. I then got a bill in the mail from the credit company. callee alled superior systems and spone with the owner (Tim Shiels), who might I add, has the WORST costumer service. He was very rude and blamed me for them not receiving the cancellation. I told him several times that I had tried to contact them for this cancellation and never received a phone call back. So I did what the contract told me to do, and yet he won't do what the contract tells him to do! He hung up on my husband not once, but twice! And told us "just pay the f**king bill". I then called the head of the Kirby company (superior systems is a third party dealer), and got my point across. The lady at Kirby verdant very happy with what was happening! She then started the mediation process between that company and myself. 

 

Needless to say, the owner of this company is sheisty and rude!! He lied about about not receiving our cancellation, and told us that he will come pick up the vacuum, but we still have to pay for it! Who in their right mind would pay for something that expensive and not keep it!! If this doesn't get settled my way, it's going to court!

Hello.  

The Kirby Company has reviewed the file from your telephone call to Consumer Relations in September, 2013.  From the information reviewed and a telephone conversation with you, you had decided to keep the Kirby and start making payments in December, 2013.  This was after you were not able to provide any supporting documentation that you mailed the cancellation notice within the 3-business days as allowed on your contract.  The 3-days is the Federal Cooling Off period.
