The talk or walk program is a joke. I purchased service and couldn't use it at my promary residence. After repeated phone calls to several agents and explaining everything 4 or 5 times they said there was nothing they could do about my service and said that it was my phone that was the problem.

I explained that I had 3 phones with that company all different and one of them from my business. Non of them worked or only worked sporatically from that location. One of the customer service agents said that it was in a fringe area. Another one said that they would be building another cell tower in that area in a few months.

They weren't able to perform their end of the contract and I cancelled the service. They insisted that I still had to pay a cancellation fee which they doubled for 2 phones. I said I wouldn't pay it because they did not perform their end of the contract and therefore the breach was on their part. I refused to pay it and now I get bills with not only those charges but other phantom charges that can't be explained.

I will let them take me to court on this one although It will probably be me that gets the bad mark in my credit report for this. My recourse is to counter sue, Which I will. For breach of contract.

My advice to anyone reading this is to not buy any phone service where you have to sign a contract unless they let you out of it for non-performance. I have since purchased a phone and service from one of the vendors that you purchase ahead of time.

I have filed in small claims court here in Colorado against Tmobile for breach of contract. The limit is $7500.00 here. I would suggest that anyone can do this as long as it's not frivilous. If you have a legitimate claim against Tmobile for their not being able to give you "Valid Consideration" or something for something that is required for a contract. Do NOT relinquish your $200.00 if you cannot use their service. The only way these large corporations will learn not to step on the little guy is to fight them in court. It will cost them $100.00s of dollars just to go to small claims court. It only will cost me the filing Fee $35.00 for my day in court. Local Judges and Magistrates will have to rule and are generally pretty sympathetic to an injustice by a faceless corporation. Folks, this works. Fight back. DO NOT BE AFRAID OF GOING TO COURT WHEN YOU ARE RIGHT. Most people will roll over and that's what company's like TMobile count on.

Trouble with cell phone coverage

Sometimes when you are having trouble with your cell phone it is a good idea to contact the manufacturer of the cell phone as well as your service provider. Especially in an instance where the service provider claims to have good coverage in the area and has attempted to fix the problem unsuccessfully. Case in point on some Motorola products the network speed option is set to medium out of the box which prevents optimum performance in areas with multiple cell phone towers causing dropped calls and call setup failures. (fixed my problem with the v300)

The same exact thing has happened to me. I had my T-mobile phone for about 3 months when I moved. Keep in mind that I had problems with reception on my tmobile phone at the previous address as well but i dismissed it because we were in a rural area. When i moved to my new home my service started dropping calls ALL THE TIME and most the time i wasnt getting any reception at all. I called Tmobile and stated the same thing as the original poster in this report; that if i couldn't even use a service that i was paying for then i should be able to disconnect my service and get service through a carrier that i could actually USE. Customer service said I'd have to pay the $200 early disconnection fee NO MATTER WHAT THE SITUATION WAS. When i asked why should i fulfill a contract that THEY arent fulfilling on their end either they stated that they would be fixing a cell tower in my area and that according to their chart i should be recieving EXCELLENT service all the time. This was over a year ago and I'm still not recieving service/reception about 70% of the time. When i called back to customer service to complain again well after the allotted time to construct the new cell tower she said that my phone would work better in different parts of town...to which my response was "you mean i need to drive to a different part of town to use my phone?!! THAT IS REDICULOUS" And just for that she said that she would give me a free month of service, BUT i wouldnt recieve that free month credit for 6 months to ensure that i stay a customer there. I THINK THIS IS CRAP.I cant WAIT till my contract expires and i can go buy a phone i can actually use.

Bud if your service goes bad after the 14 day trial there are a lot of things that Customer Service can do for you. Ask them to send you an OAA Flashing or an update to the sim card which will help you get a better signal or stop dropping calls. If that doesn't work then it has to be the tower in your area. Have them file a trouble ticket so one of their technicians can go out and see if maybe there is an outage or maybe blockage getting in the way to cause not a full bar of signal....if that still does not work...i would speak with a supervisor....tell them that you should not have to pay any Early Term Fees and should be let out of your contract because someone sold you service in an area that is a fringed area and it is not fair because you can not use your cell phone. Don't let them sit there and say it is a phone issue because it has NOTHING to do with the phone...if it was a phone issue it would only be happening to one line...and in this case you said it was multiple lines I hope you get this taken care of

Tmobile is one of those utility companies that think that eventually you will get tired of their incompetence and the hassles and just pay the bill. I won't do it on principle on this one. I'm here to voice my opinion AGAINST Tmobile and this venue is for this purpose. Not to solicite an advertisement for Tmobile as is the case from the person who rebutted my letter. I'll say it again; If your service turns to cra* after the grace period it is still breach of contract. Period. Because there is no valid consideration, a contractual obligation that makes a contract enforceable.

Hello, I'm sorry to hear about your troubles. The buyer remorse period is 14 days (30 days in CA). You can breach your contract within the buyer remorse period and not pay an early termination fee. I would just like to make consumers aware of the following: The activation fee per new line of service is $35. The early termination fee is $200 per line. Do not believe anything else. If your T-Mobile termination fee is ever more than $200 per line then you are not doing business with T-Mobile, you are doing business with an indirect (middleman) dealer. Middleman dealers offer their own deals on PHONE PRICES ONLY. They cannot waive your activation fee, extend your 14 day remorse period, or accept payment of your T-Mobile monthly bill without additional charges or fees. As for legit T-Mobile owned retail stores, do not believe a rep that promises to waive your activation fee. If such deal is ever offered, get it in writing and do not leave until he creates a memo on your account. Reps are not allowed to waive activation fees, only regional managers can waive activation fees. And yes, you can always pay your T-Mobile monthly bill at a T-Mobile owned retail store without additional charges or fees.
