seems to me the rep was incorrect becuase if this was a NEW handset you have 14 days to return a defective handset. If a replacement was sent (called an advance exchange) then she did NOT follow policy. Of course on a warrenty exchange you are going to get a new or like new phone. its a warrenty!

I have been with T-mobile for 4 years. in that 4 years i have had a samsung 315, nokia N-Gage QD, Side Kick II, The Magenta Razor (pluse one replacemant) The Gold Dolce and Gabbana Razor limited edition (i am now on my second replacement) the rep tells you that they can not guarantee you that you will receive a new phone, now having been in the same situation myself i understand how you feel and why u feel that way. But the information is giving to you when the order is placed. if your replacement device is deffected as well, i would take it to the t-mobile store not a kiosk, (the people at the kiosk are there just to sell phones and start new servic)e and have the see the issue themselves and explane you situation and tell them that that is a replacement, and have them call customer service, and remain calm, and be respectful, and i bet you that you will walk away with a new phone that works.
