I was a employee at the Toyota Mall of Georgia at the time of this incident. The procedure of terminating a customers lease is as follows: The customer wishing to terminate their lease would fill out a "lease termination form". If there are excess miles on the vehicle over and above the contractual agreement then the customer would be responsible in making those payments according to their signed agreement with their leasing company. The terminating dealer (Toyota Mall of Georgia) would act as a termination site only, and would not be responsible for any excess miles, or wear and tear of the vehicle by the customer. The customer is required to sign a early termination form in which the mileage at termination is confirmed by the dealer and signed off by both the dealer and the customer. The customer was given a copy of the form that they signed and a additional copy was faxed to their leasing company as a courtesy, to notify the leasing company of the location of the vehicle.
In the statement provide by the customer; the customer admits that they were aware of the "over mileage" of the vehicle they turned in. However, furthur down in their complaint they accuses the dealer of the 23,000 excess miles on vehicle.
"I told them that I had turned that lease vichel in, and payed 9,500 dollar (5,000 in cash and finance the rest into my new car) for early lease termination and over milage on 7/14/01 to toyota mall of ga."
Customers are responsible for any excessive wear or tear on the vehicle according to the lease they signed with their leasing company.
This customer in his statement said "I also found that the dealership had put 23,000 miles on my car while they had it, it had to have new rotors because they were wore out, a new master cylider, new brake pads, new tires, and the oil had not been changed costing me another $1,200 dollars."
Toyota Mall of Georgia did not drive this vehicle. it was put into the back lot and labeled "lease turn-in" with a grease pencil on the windsheild so it would be identified for pick up by the customers leasing company. When the customer came to pick up the vehicle the reason the battery was dead was because of the extended period of time the vehicle sat on the lot waiting for the customers leasing company to pick it up.
This is a case where the customer went way over the mileage allowed by his leasing company and was charged for excesss mileage and excesss wear and tear . This agreement was with Bank one and not Toyota Mall of Georgia. The dealership followed procedure, however the customer tried to come up with a EXCUSE FOR THE EXCESSIVE WEAR AND TEAR by falsely accusing the dealer of wrong doing.
Mr. Esfahani is a very moral and just guy. He goes out of his way to help customers and that's why it is the largest volume Toyota dealer in the state. Customers get great treatment and fair prices. It is unfortunate that this person wrote this and used his name. This gentleman drove the new vehicle for 5 months then decided the payment was to much for him...Hmmmmm. The irony of the story is that if this guy really had spoken to Mr. Esfahani, regardless of the fact that he was trying to get out of his responsibilities, Mr. Esfahani would have helped. He is a good man and is being falsely accused. I feel like I had to say my part about this because, IT'S WRONG!!!

Jackie, most car dealers do not care as to what happens to car buyers just as long as you sign the papers on a new car and take it home. It is the job of your dealer do make sure that all paper work is taken care of, and that if they offered to have you drop off your old lease on their lot that they should follow up and make sure that your old car is sent to it's owner being your leasing company. I also feel that they are responsible for the extra miles on your old lease SUV. jackie I feel that if you get a real shark of an attorney you have a VERY strong case against this sucky car dealer.
