Hi D, They told me the same thing also about the deferment they did for me back at the and of last year. I know for a fact that since you are in a few months since that happened they can rescind it as long as it was stipulated in the paperwork they sent you to read and sign but however it will just add another month that you are behind. They can not show it as being 6 months late unless you actually are after applying any payments made after that deferment was done. Also to they are stating that it was in the paperwork and after having my family attorney look that over and everything else we ever did with them they do not state that at all and I do have those conversations recorded and I was never told this on the phone either. My sister is through ************* and she has had no complaints about them as they have much better standards and they worked with her also when she was out of work for 6 weeks. I wish you luck with them.

I have been down that same road with Triad. I had an extension last November, and I was not 30 days behind on any payment to them, and I called them to tell them I would be making my April payment on the 12th of May (due date being the 15th)so it wouldn't be 30 days late, and I would be making the May and June payment on June 9th, which would catch me up. (All this due to my wife being off work for several weeks from 2 surgeries in late March, one for a life-threatening condition). Triad said that was unacceptable, and if I didn;t make the May payment by the 30th, they would recind the Nov. 05 payment deferrement and place it back in to the account(making that payment 6 months late). Now mind you, I paid a FEE for that deferrment, but they threaten to put it back. They do this to try to force me to send money that is simply not available. Of course, we all know what would happen in that evernt. That 6 month late payment would give them as reason to repo the car. These people are scum. I am glad (I think) to say that I have successfuly traded off my car over the weekend, and got financed through Citifinancial Auto (yes, I know there have been a few complaints about them). I got a much better rate, considering my credit score. I also found out out from the Finance feller at the dealer that Citifinancial Auto is owned by........(drun roll, please).... TRIAD!!! Did I just jump out of the frying pan into the fire? Only time will tell. I have my finances in order now, wife is back to work, so, barring getting kicked in the financial nuts again, we should do fine. If I need to talk to anyone at Citi, it will be Citi employees and not Triad(thank god). Having said all that, Angie, I want to be a part of the class action. We cannot stand for this anymore from Triad. Triad must be brought down. Once this class action is started, we should also get the media involved, and start picketing their offices wherever they may be. We should get the word out and splash as much bad publicity on these turds as musch as possible. Peolple must know about this 800lb Triad gorilla.

It was very wise of you to file with your State's AG, but also file with the FTC. As far as joining the Class Action, I've got you covered. I'll add you to the list. Hope everything looks brighter for you soon.
