This woman is mad because we will not refund her deposit. Deposits are non refundable as posted in the shop waiting room. Dan was fired in April and Jean was made aware of this right away. All phone calls are answered as this is a business. Never was Jean told the car was in a 15 bay shop or a date of compleation just an estimate. We are a small two bay shop and that is very obvious from our pictures on our advertisements. The car was parked on the street as all cars are because that is the only available parking. That is where we park all cars customers and employees. The car was parked right in front of the business in a legal parking spot until a bay is available. Jean was warned not to use offensive language on several occasions. After she cussed me out several times I did eventually hang up on her but this was after explaining in detail the situation with her car and reassuring her it would be finished and we are just waiting on another engine. The company who sent out the wrong engine was called LKQ and is a very reputable parts company I had been using for years. I can't tell you why they screwed up the first engine. I use this company because they are quick, reliable and they back up their warranties. This was the first time they sent the wrong part to our business in five years. They were being very difficult and refused to exchange the engine. I have the original invoice that states the date, time and engine they shipped. I threatened to sue them but never did. The "little girl" Jean refers to is in fact our secretary who is an adult and licensed accountant. She quit after being harrassed, cussed at, and threatened by Jean for weeks. As far as the engine yes it took longer than expected. No business is perfect and we have problems just as any other business. LKQ quoted us a good price, we offered our customer that price. When the wrong engine arrived LKQ refused to honor their original price for the replacement engine. They told us the engine we needed would cost us almost double the original price which we could not afford. On top of that Dan had failed a drug test and was immediatly fired. He was the technician working on Jeans car. That put a further delay on things. I explained this to Jean several times but she continued to threaten us and harrass us. She constantly cussed at me. This was my business and I do not tolerate that kind of language. I try to be as professional as possible and do not cuss in front of my customers and expect the same in return. Jean cussed me out several times on the phone which I warned her to stop or I'd hang up. I was trying to work with her in every way possible and even offered a discount for having to wait a couple extra weeks to get her car back. Without notice she called me and cussed me out once again (I've had my share of rude customers but she was by far the worst) demanding I drive out to the shop and give her the key to the car on a day when the shop was closed. She made a big scean and towed her car home and that was that. I wasn't aware she was going to take her car. Last time we had spoke I told her the engine was on the way. She just got upset we had her car outside. We never said we would keep it in the shop. It was under 24 hr watch by our security dogs and cameras. We have since gone out of business due to the inability of several of our customers to pay for work rendered. I understand she is mad. I'd be mad if I threw away $1650 but that is our policy like most businesses deposits are non-refundable. If we were unable to complete the job I would issue a full refund but Jean signed a contract and then violated it by takeing her car back. I'm out $1000 and shes out $1650. If she wants to sue me that is her choice but don't lie about the whole situation. I have all the supporting documents and phone records I would need to defend myself.
