I was promised and guaranteed employment by Swift Transportation and the United States Truck Driving School when I applied for admission in May 2001. I had a felony at the time and told the school's representative about it and was told "that's not a problem, Swift will hire you." So I signed up to get a CDL and quit two jobs to go to school. The instructor I had was fine but when I went to a three day orientation hosted by Swift in July 2001 I was sent home a day and a half into it due to my background check.

I have been unemployed for over a year, finally took care of my felony in May 2002 and still can't find a company to hire me. I already owe the school $6,000-$7,000 and they want me to take a 'refresher course' due to not driving recently. The catch is I have to pay them upfront to take the course due to my first loan being past due.....DUH! Of course it's past due. If I have no money coming in, none will go out. And to top this whole thing off, the DAC has wrong information on me that is costing me more time and hassle.

So now I not only have ONE company to fight with, I have another one who holds the key on getting me a job or not!

First let me say that after 7 years in OTR driving, yours is hardly the first case I have seen where what you were told before orientation and what happened when you arrived were VERY different things. I am sorry that in this cae, the result was near terminal to your employment chances. Having said that I do have a couple suggestions an points for you. First, you will have to take a refresher course to get hired by any company. With no experience and almost a year out of a truck, no company will fire you with this. Either a school based refresher course or a company that runs their own school and can supply it that way. As for your felony issue. You said you got it resolved and indicated it's no longer on your record. If thats true, your right in that DAC will still have it in THEIR records. You will have to contact DAC to correct the records and given the time passed and circumstances, I am afraid it may require legal help to completely resolve that end of it. If in fact the felony IS still on your record and you simply got the penalty part resolved, then your basically screwed. The majority of large trucking companies will not touch anyone with a felony conviction (or arrest in some cases)within 5 years. My only suggestion there would be to look for companies (and there are many smaller ones) who do NOT use DAC as their reporting service and/or will be more forgiving in what is in your past. The important thing you have going for you is that you DO have a Class A CDL. That means that you may have to work alot harder to find a job with your problems here, but you CAN find one. It may be local rather than OTR....or it may very well be with an OTR company that won't be all you want it to be....but with experience..You can trade 'up' in companies until you get what you do want. Final suggestion to you on this. Clear up and get accurate your DAC records (or at least get a rebuttal put on the DAC record) and submit your application through as many online application services as you can. Each will usually submit your application to 10-40 companies at one shot. The shotgun approach in applying really is your best bet in finding a company who will work with you. Just be 100% honest on the applications. Hope this helps
