I was involved in auto finder bender in 7/20/2003 due to I was learning how to drive. I had offered to pay the person for their damages and they had accepted the money. Then this year I learned that this individual had filed a claim not with my insurance co but only with hers. Now they are trying to recoup payment of her lost they claimed that her vehicle was a total loss and according to secretary of state they salvaged it and tagged to be rebuilt as of 8/25/03. Now they have continue to change the amount of the alleged claim on several occasions. they are now trying to recoup this money when the incident occurred in 2003. This person was indeed involved in another auto accident and didn't report the incident and now the insurance company is trying to say that I was the cause of her vehicle being totalled as they claimed in August 2003.

Seems to me that the burden of proof lies with the insured. She has to prove that you hit her. With no police report or witnesses, this will be impossible. I would contact your the Insurance Commision in your state as well as the Attorney General and report that insurance company. Write a letter to the insurance company and send it ceritified, return receipt, and inform them that you have reported them to proper agencies, and all collection attempts are to cease immediately. Tell them not to contact you unless it's by US post certified mail, not by phone. Just for the record, accidents have to be reported to the insurance company within a couple days, not years.
