In yet another chapter of my continuing battles with DAC/USIS, they are once again publishing false or intentionally misleading information regarding my employment background. In this case, a prospective employer has informed me that DAC/USIS claims I had "22 accidents / incidents" while employed with Werner Enterprises, Inc. from 1997 to 2000. Werner has stated clearly that they made clear only one accident from March 1999 was my fault, the remaining "accidents / incidents" were denoted clearly as not my fault or third party reports by myself regarding equipment damaged by customers or other drivers. The prospective employer, however, was instructed by their insurance carrier to not hire me as a result of the report received, which does not differentiate between driver at fault, driver not at fault, accident, or incident.

DAC/USIS has also made it a policy to "volunteer" highly sensitive personal medical information regarding a birth defect that has no effect or influence upon my ability to perform every aspect of any job, with said revelation resulting in my termination from one job, and denial of employment in at least 6 oher instances. While my termination and denial of employment on that particular issue are illegal, so is the release of confidential and sensitive medical information under HIPAA (the Health Insurance Portability and Accountability Act, which includes medical privacy regulations).

Attempts to obtain a complete copy of all information they both possess and are selling regarding my employment and medical histories (and anything else they have) have been ignored. I have made requests both by telephone and by postal mail many times over the last 7 years, the last few directly to USIS. To date, I only have been able to obtain anecdotal information from those employers willing to tell me what is going on. My understanding was that DAC/USIS are bound by the rules and regulations of the Fair Credit Reporting Act (FCRA) 5 U.S.C. 1681, and that as such they were required to provide the copies I have requested. However, I have yet to receive anything from them. The explanation given by telephone is that DAC/USIS is not obligated under the FCRA to provide me with anything. They also claimed yesterday by telephone that HIPAA does not apply to them, and that any medical information they can obtain through whatever means shall be made freely available to whomever requests it (and in a few cases to those they volunteer it to it appears).

Request documentation from each alleged accident/incident. Every major company documents this stuff. Send your request by certified mail, return reciept requested. Also send the info to USIS. DAC does not exist anymore. USIS bought them because of financial and legal troubles due to this sort of non compliance and unfair practices. USIS must obide by the fair credit reporting act. This was determined by a judge about 1 year ago. Same rules, prove it or remove it. I have had my run ins also with both DAC and USIS. I had to file a DOT complaint against 1 employer, just so I could have documentation to rebutt the DAC report!
