What do you do against a realtor(s) who didn't disclose lead-base paint contamination in the house you bought from them? They are walking away with their $40,000+ commission and could care less. They claim that the put a lot of effort into making it right, tried renting the contaminated property, making all kinds of false and stupid statements to other people but never, ever follow through???

They are trying to save face, that's all they are doing. Letting their lawyers do the dirty work and in the meantime, you are stuck in a "bad" or "sick" house that needs to be fixed or repaired so you can sell it again.

In order to get a "clean bill of health" by the EPA all lead needs to be removed, that's simply the best and most responsible way of doing this and being able to eventually sell this house again without any hazzle or law suit following. They knowingly didn't disclose the lead-base paint because they sold the house 3 years prior. They also knew that if they would introduce any other issues with the house, such as "it can't be rented because the house has lead-base paint in it" we would have not purchased the house and they would have lost a sale and enormous commission. Do they even know of a CODE OF ETHICS?

I am extremely upset, do not trust in people any longer, definitely have no trust in the legal system. The bad ones always win, the good ones look stupid.

This client was not only offered to have the home purchased back at full price plus any costs, but she was also given the opportunity at our expense to have the home tested and if anything did exist, our company would have paid for that in full.   All this if fully documented.   She refused because she is of a ligitious nature.  Barbara Killian a new realtor in 2003 at that time did in fact forget to attach this form for the home but had never sold the home prior as this client states, she had only been licensed.  

What she states is This is false.  She did not win the type of funds she was looking for during mediation and was very unhappy.  She and her husband divorced quickly after purchasing the home and tho her husband wanted was very gracious and understanding and knew we would take  care of all this, she did not and wanted to go to court from a "friendly attorney" she had.    All this is documented.  On top of which the likely hood that any lead base paint would be found in a Bay Hill Country Club home is ludicris, this client is a litigious person.  Again, we have documentation showing we wanted to from day one take care of this client and keep them happy.
