You went through a re-seller of services (any service not provided directly). Russell Cellular is simply a company that receives compensation from a cellular provider for offering their product for sale. Russell has no cell towers, no equipment - they simply SELL SERVICE.
Your contract with Russell clearly states this simple fact, just as it states the length of your obligation. You suggest you had, "month to month service", which is in part correct. However, details of the contract will most probably show your obligation was to continue this "month to month service" until your TWO-YEAR CONTRACT TERM expired.
Again, Russell is simply a re-seller. Had you gone directly to a cellular provider, you would have had a choice of MANY PROVIDERS. Instead, you went to Russell - a company who deals with ALL CELLULAR PROVIDERS and they provided details on the best plan based on your needs.
Most importantly, you are bound by the terms of the contract with Russell. The fact that they, "...assigned this service to Alltel...", which was later bought out by Verizon does not release you from the terms of the contract. You were not released from your obligation when the companies merged.
You indicate that, "After a few months of paying for service charges not ordered by myself" - you canceled service. You were (and are still) obligated to remain with Russell for two-years. Note, REMAIN WITH RUSSELL for two-years; they held your contract. You were their customer and they arranged service through Alltel. You received services (your cell phone functioned) for dollars paid - you failed to remain for the duration of the contract and were thus billed an agreed upon amount.
Keep in mind, Russell was paid a fee by Alltel when you signed their agreement. Not honoring the terms and terminating service meant Alltel was out of pocket the amount paid to Russell. They are entitled to recover those fees, no matter if they were greater or less than the $200.00 you were penalized. The amount is your obligation for terminating. Had you read the contract - this would be clear to you.
Sorry -- you are out the $200.00 and Alltel/Verizon ahs recovered the loss they suffered when you terminated.
