I ordered a shirt from this dealer in early December intending to give it as a Christmas gift.  Later, the vendor offered numerous excuses as to why I would not receive the item until after Christmas.  Then he notified me that my order had been sent to the wrong address and that the package that would be arriving here actually was intended for another customer.  When the package finally arrived, I did not open it, so I don't know what was actually in it.

 

All communications to this point were via email.  The dealer demanded that I send the package I had received to athird party address.  The dealer was very rude and tried to become intimidating.  I told him I was not intimidated by his lousy attitude, and he forwarded more threats from somebody in Oregon DBA Devil Dog Shirts.  I told him I was not making a special trip to a post office just because he was too incompetent to conduct his business in a professional manner, and he claimed he was going to charge me for collections plus a $100 administrative fee.  I told him my administrative fee for dealing with scammers was $250 plus expenses and to subtract what he claimed I owed him from what he owed me.  He claimed he had sent me mailing labels via email, and I told him I did not download or open email attachments.  Finally, a mailing label arrived by USPS and I sent the package on.  I had already paid for the merchandize I ordered.

 

Also, I was very disappointed with the low quality of the merchandize.

 

This morning I received and email from Joseph Mancini at Asset Collections Inc in Beaverton Oregon demanding payment of $250.13 for an item that arrived very late and that had an original cost of approximately $33.  I am also apparently starting to receive harassing phone calls.

 

I am reporting this to appropriate authorities as an online scam and an extortion attempt.  These vendors claim affiliation with the USMC, but they are a disgrace to the  Marines I have known and associated with for many years.  A more appropriate appelation could be SCUM.

I received the following email tonight from [email protected]

"Hello C*CK sucker. How are you today. If you think for a second I have forgotten about you I have not. You are your f*cking ugly wife will be exposed for the thieves that you are."

The wording matches several harassing phone calls I have received in which the caller had a slurred voice and was obviously drunk.  Perhaps Mr. Gilbert doesn't understand that making harassing and threatening calls across state lines is a federal felony.  I believe Mr. Gilbert is not a veteran, but I also believe he is a pathetic drunk who needs to get a life outside a bottle.

Today our company spoke with our collections company after reviewing some dead files and we ran across the uncollected person Phillip Deporter. This gentlemen who falsified his information above because he ws unwilling to return merchandise he paid for has been found to be in fact the recipient of several different collections company and appears to have a history of collections pursuing him.

This information was easily discovered whn we researched his prior purchasing experiences. To date Phillip Deporter, whoc claims to be a US veteran, still ha not paid for merchandise he paid for and has never returned merchandise that was incrrectly sent to him even after a pre paid shipping label was provided.

He claims to have shipped it but has never once provided a tracking numbr of proof. We find his statements above to be false in ther entirety and given the new information regarding his collctions history appears this isnt the first time DePorter has been placd on the collections merry-go-round. A pattern seems to be forming and his prior actions to appear self evident in terms of other companies conacting him related to collections matters.

He patented response is requesting a cease and desist whenever a collections company reched his regarding a dispute. We are fully confident we have done everythign possible to successfully requst payment for mechandise he did not pay for but sadly his previous history and his recent on with our company will likely prove to be unsuccessful.

As a military owned and operated company I would never go into combat with a Blue Falcon that he has demontrated to be and wound never expose my back to him.

Deporter never returned merchandise he paid for and to date contunues to ignore requests to return merchandise he did not pay for. Our other customer received hos order (we printed a new order since DePorter would not returne the other customer's product wven when we sent a pre paid lable) and contunues to keep mechandise that is not his and that he did not pay for. Deporter is a liar and is subject to slander and is presently being investigated by our legal counsel for his deceptions, lies and untruths.

First of all let me introduce myself, I am the head of production in charge of producing and shipping merchandise for VSW and DDS. I have been doing this for almost a decade and like most human beings, make mistakes. During the Christmas season we have thousands of orders come in and out in a small 2 month time frame. We fulfill hundreds of orders a day and I have been in charge of this for a long time now, am I perfect at my job? No, but I am very good at it, although mistakes do happen I have always prided myself on trying to get them resolved in a timley and efficient way for the customer, because i do realize it is an extreme inconvienence to order a product and receive the wrong item. Here is the way this sitautation went down.

We shipped Mr. Deporters order under another customers order number by mistake and visa versa. This was cuaght as the packages were in transit to the customer and we filed delivery intercepts with the Postal service but they were not completed. So I emailed both Mr. Deporter and the other customer asking them to please simply print out the attached shipping labels and put them on the packages that they were receiving. I explained the sitaution to both customers and told them that I was at fault and was paying for expedited shipping, and all they needed to do was put the labels on the packages and hand them back to the post office or set up a pickup for them. The other customer is already shipping your package out, it is a 2 day ship from him to you. If I was to reprint everything it would take 3 business days to get the product plus the 2 days shipping. So I am trying to get it to you the swiftest way possible. I am sorry for the issue and I assure you this is the fastest way possible for us to get you your product, after our mixup. All you have to do is when the package arrives is put the new shipping label on it and hand it back to the post office. I have already confirmed the other customer is doing the same thing.

Mr. Deporters package (order # 16385) was supposed to be an Extra Large, Navy Sweatshirt with a front logo, made in the USA. The package that was accidentaly shipped to him (order #17385) was 3 Custom t-shirts, 1 beanie and 2 coins. Two very different packages and content. And as you can read from the correspondence he never said anything about not opening the attachment (which was explained to him many times) until almost 2 weeks after this correspondence took place. I tried to be professional and get the problem (that I caused) fixed on my dime and make it as easy on both customers as possible, but Mr. Deporter continually turned to threats and sarcasm and then blamed me for being unprofessional. We mailed him a return label and he proceded to send the Sweatshirt back to the other customer instead of the 3 shirts, 1 beanie and 2 coins.

Mr. Deporter is still in possession of these items and continues to defame this verteran owned company and call us a scam. We are simply trying to professionally solve a problem (again that I created) and get each customer what they ordered. I have called Mr. Deporter many times and left messages asking him to call me back to work this out, but I have received no call back or any correspondence what so ever. This company is run by individuals who truly care about thier customers and will bend over backwards to make things right, but when someone is holding onto merchandise that is not theirs and continually berates and belittles people trying to make the situation right, there has to be another coarse of action. Which in this case was filing collections after many attempts to retreive the merchandise Mr. Deporter was in possession of and threatened to throw in a dumpster. I have over and over again admitted on here and to Mr. Deporter that I was at fault and was paying for all the expenses it would take to fix the issue, but he continually used name calling and sarcasm towards me instead of working with me to get him his merchandise and the other gentlemans merchandise. I will accept full blame for causing this issue, but I will not stand by and let him slander this company and make false accusations when we did everything in our power to make it right.

Customer still has not returned merchandise that does not blong to this individual. We possess all proof and information that this person has not returned our other customers merchandise. Secondly, we are inveestigating small cmalims for return of merchandise. Again we are in possesssion of all facts pertians to their lack of return of merchandise. Third we are seeking legal counsel on actions involving slander. Customer has not shown any desire to cooperate and return the merchandise they did not pay for. We are seeking our legal rights in this manner. Our counsel is under advisement.

I think I see a pattern of attacks from this proprietor in calling and attacking in later evening.  From past experience, I suspect overindulgence in certain refreshments may be cluding his "judgment" and memory.

Unlike what this individual claims, I did return the merchandise sent to me in the first package.  I was also very disappointed with the low quality of the merchandise I received in the second package, but I had already payed for it and did not want to deal with filing a complaint through my credit card company.  As it turns out, his incompetence is what started this mess.  He sent me the correct merchandise in the first package and then told me he had sent incorrect merchandise.  Since I thought someone elses' order was sent to me, I did not open the first package when it arrived and mailed the unopened package the very next day after I finally received mailing labels via USPS, as I told him to send them.  The true nature of this company can be ascertained via the following links:  https://www.bbb.org/oregon/business-reviews/army-and-navy-goods/vision-strike-wear-com-in-portland-or-22632209/reviews-and-complaints

Now, apparently this scammer is teamed up with a collection agency to try to strong arm me into paying a fraudulent bill of over $250 for a package that cost $33.95 that I no longer have and that was paid for in full via credit card when I ordered it.    Information obtained via Linkedin even leads me to believe he is not even a veteran as he claims.

Perhaps the proprietor does not understand time zones, but my area is several hours ahead of Oregon, and his calls from there fell considerably after the appropriate time for business calls had passed here.  That generally is considered to be harassment.

A Google search on "Vision Strike Wear complaints" will reveal the true nature of this company.  Visions of fraud and of stolen valour fill my head whenever I think if this mess.  BTW, anyone can claim to be a veteran-owned company.  The claim is never verified unless you try to do business with the government, and even then the verification process is not very reliable.

As a side note, soo after all this mess arose, I started seeing fraudulent charges on the credit card I used to place the order, a card I use almost exclusively for this type of business.  It leads me to wonder if my card number was sold or misused before I froze the account.  Phil - Knoxville TN

What appears to be missing from this claim and the reason for collections is this customer did not return the merchandise to the other customer. We made several attempts to email this customer with shipping labels and informed him of its nature and content. In his effort to make things difficult he responded after we made several attempts to get him mailing labels that he was not going to open emails. 

We then elected to mail prepapid postage so the package he received incorrectly could be mailed to our other customer who was patiently waiting for it. It was our goal to make sure both parties recceived what they had ordered. This individual who is making these slanderous remarks did not in fact return the merchandise to our original customer. He returned his own single sweatshirt and is in possession of our other customers order in excess of 116.00 in unpaid merchandise.

We have since printed an entirely new order for the other customer to ensure they get what they ordered since this customer was unilling to return the merchandise and was subsequently placed into collections or as he stated received harassing calls which were nothing more than professional collections calls aimed at returning merchandise or paying for the costs caused by the lack of its return. 

As a US Marine owned and opeerated business and one that has the highest regards for its customer we cannot in good conscience allow incorrect statements from being made which are wholly incorrect. We have all the documentation to include emails and content from all parties including the customers whose order was not returned by this customer and we reprinted them their order since it was important to us that they receive their order. It is extremely sad that the details have been incorrectly stated by this customer.
