I had my van serviced at a Walmart Tire & Lube express and the technicians lifted it wrong causing the lift to go through the running boards damaging them beyond repair and making them usless to use as steps as intended. They admitted fault and advised me to get an estimate.

It's a conversion van and when the dealer estimated repairs, it came to $1152.93. I was then advised they had to submit a claim on anything over $1000 and would be contacted in regards to the claim. I was then contacted and offered 75% of the damages due to "depreciation" of my vehicle as it isn't new. The body shop advised it would take 4-5 days to complete the repair and Walmart stated that was false and they would only cover 1 day rental. So, instead of repairing, they offered $894.69 and stated I would be responsible for the remaining damages!

Of course we declined the check as it was unfair, so they sent a letter of their offer and Walmart Corporate refuses to respond to a letter I sent them Priority Mail 12/8/03 or numerous emails. I guess that/s how they can offer low prices... everyday.

While we're on the same subject... I will never go to Wal-Mart to have my car serviced ever again, no matter how good their prices are

I had my car serviced at the Wal-Mart Tire & Lube Express in Somerset, KY. I got an oil change and wiper blades replaced. I take a walk around the store... 20 minutes pass, so I go to check to see if my car is ready. First thing they say to me was, "Did you know you had a crack in the windshield?" (almost like they were hoping I would say "yes") Of course, I said no I never drive with a crack in the windshield. After talking to 5-6 seperate people, trying to get the story straight, I finally get the manager. Turns out that the stupid mechanic who was changing the wipers let go of one of the blades when the metal was exposed and crashed down on my windshield, which left a two inch crack. I was of course, furious. I filled out their insurance forms and they requested that I get 3 estimates for replacing the whole windshield. Long story, short... their insurance gave me the middle-rated estimate, which was $380. I didn't want to get a whole new windshield because the seals never fit right ever again, so I cashed the check they sent me and had my windshield fixed for $40. You could say I made out, but I have a crack in my windshield on my brand new car. I will never go to Wal-Mart to have my car serviced ever again, no matter how good their prices are.

try to offer a depreciated amount to try to settle the claim

I do realize that you are frusterated with this situation, and I as a member of Management For Another Mid sized Retailer. I know that it is usually policy to try to offer a depreciated amount to try to settle the claim. I also know from going to court many times defending the company I worked for, that, By Law a company is required to put your vehicle back in the same condition it was in before they screwed it up. In saying that they will try with every effort to determine if there was any prior damage to your running boards. If it is determined then even in the court of Law all you will recieve is a depreciated $ Amount. As far as the car rental I think you need to read thier expressed warranty, on the invoice . Most Companies do not assume any liability for loss of use.
