weltman and weiss, largest collection agency in the country and one of the most ruthless and rude. several years ago i bought a car from a buy here, pay hers compan, m&s financial servers, aka, abc motorcars, akron, ohio. shortly after the purchase, while driving the car, the entire right wheel assembly fell off the car, not just the wheel, the entire wheel assembly.

fortunately i wasnt hurt. the dealer did pay for the repairs but i took the car back as it was unsafe. then abc motors turned me over to the law firm of weltman and weiss. they attached my wages for 3 years, would not talk with me, work out a lower payment plan, i paid $470.00 per month for a car i no longer had and had pretty much paid off. attorney julie vicarrelli was assigned to the case, would not talk to me, finally one day a letter came from her saying, "as long as we can attach your wages, we dont need to deal with you" i was off sick for 3 months last year and they still attempted to attach my wages even tho i was on sick leave and not being paid. then they released me from the attachment. 6 months later they strarted it up. i filed for trusteeship to stop the attachments, they still get paid but at a lower amount.

june, 2005, the cleveland plain dealer ran an article titled,DEBT-COLLECTING LAWYER MUST PAY $2.9 MILLION, robert weltman the owner of weltman, weiss was sued in court by atty william gibbons. weiss and his firm sued an 82 year old man, his wife, his daughter, his son-in-law and the grandchildten. the client had the money set asise in case he was fond liable but weltman sued without asking the client for the money. "it was one of the supreme acts of arrogance that i've ever witnessed and the jury thought so too," said gibbons. gibbons was awarded 500,00 in lawyer fees. "the money is not important part, the important part is to stop attorneys from manipulating the legal system and thats what bob weltman did." said gibbons. JUSTICE SERVED!!!

i put my compaint under debt collector because that is what my compalint is about, the car dealer is secondary in this complain and i have filed a separate complaint against that company. my complaint wasnt so much about the wage attachment as it was the way this company treated me and others, the harrassment, the harrassment of my employer, the refusal to even talk with me but to just be vindictive.. when this firm was sued by another poor guy and had to pay 2.9 millin as well as 500,000 on attorney's fees, it did my heart good. i have reolved the issue of the attachments by filing for trusteeship, i wanted others to know that sometimes justice can be served. please re-read what the news article had to say about weltman and weiss. thank you. john

I did make efforts to protect my rights, also in ohio, there is no means test, if you lose the jusgement, its 25% of your gross each payday. mine happened to be one fourth every payday. when i attempted to work out arrangemts with the law firm i was ignored, then told, we dont need to work with you, we can attach your wages. i had no hardship to claim. also, i was advised that once a 15 day notice was filed, the crditor did not have to file anymore and that the wages can be attached until the deby is paid in full, this is in ohio. the wage attachment can be stopped by that company only if another creditor files for attachment. the first creditor then waits. the cleveland plain dealer stated that weltman and weiss were the largest debt collection agency in the country.

NCO Group is the largest collection agency in the world, then there is MCG as #2..etc.. Then just a suggestion to get your complaint found, post it under the appropriate category. You are complaining against a debt collector, but put your complaint in the auto dealers section. And, they couldn't just attach your wages without first filing a lawsuit. It appears that they filed, you failed to respond, and they got the default judgement. Then they applied for the garnishment, which you also have a chance to respond to. You can claim hardship and take a means test. They can only get a percentage of your disposable income. I feel bad for what you went through, but you did not even attempt to protect your rights.
