I took $15000 to Memphis Tennesse in February 2008 to west Memorials to purchase a grave monument for my son Noah who was killed in a vehicle accident. Arrangements were made and promised delivery by September 2008

They were unresponsive to E-mails and phone calls during the duration.

Final delivery was on November 26, 2008. They were supposed to contact the cemetary and myself of delivery, they Did not. When I came home from work and saw the monument, I found that of the 2 bnonze plaques on the monument , one was fine, the other one was extremely bowed out with a 1/2 inch gap in the center. A cross and star on the front of the monument were supposed to be inset, they were not. They were not even flush with the marble, both were mounted crooked and you could see the mounting pins on the cross.

I immediately contacted Missy West, who became very defensive and nasty. Saying it was fine, nothing was wrong. This is so idiotic that anyone could think this would be acceptable for $25000. They had been paid $21000 at this point. Missy was so irrational, she even argued to another person who was in the graveyard when I ask him to try talking to her and explaining the situation, since se had made me too mad to try talking to her anymore.

I immediately contacted my attorney who instructed me to take pictures of the plaque, take it to another memorial comapany for evaluation. I took the plaque to Jonas Memorials in West Harrison indiana , who wrote out a paper detailing the bowed bronze. Jonas also informed me of who the manufacturer of the bronze was and how to contact them.

I contacted my attorney, contacted the Better Bussiness Bureau in Memphis, send an E-mail to West explaining what we intended to do. The manufacturer of the plaque, Trigard Bronze in Danville Illinois who requested pictures. They responded in writing that they would straighten the plaque and return it to me. West memorials contacted them and coerced them to return the plaque to them. Then West Memorials left a message on my phone telling me to send them the rest of the money and they would return the plaque. They also left a phone message for my lawyer saying they would come up and reposess the monument.

We have tried to handle this nicely, have advised them to please work with the legal system , through the courts to straighten this out. they continue to threaten to take my sons monument - I have pai $21000 on this so far, my lawyer instructed me to not remit more money until satisfactory corrections were made. PLEASE HELP ME.. The police dont know what to do , I have contacted the FBI, US attorney Generals Office, no help... Please help me.

#2REBUTTAL Owner of company

Mr. C recieved his plaque and we received payment. He was attempting to avoid paying the balance of the money owed. When his deception did not work, he resorted to threatening my company with the BBB, FBI, online complaint sites etc. When this did not work, he threatened the life of my family. He called my bronze supplier, whom he was trying to dupe into sending a plaque to him, and told them he was going to go to Memphis to "blow their heads off". After notifying all police departments involved, I was advised that he was unstable, had a record, and it would be best to cut my losses for fear of his threats. The poor man at the cemetery he mentions also felt the wrath of this man because he did not pour the concrete correctly. We are used to working with families during their most troubled times. We have two complaints with the BBB in the past 3 years, all were resolved and I received a letter of apology from one. Considering we have had over 2000 clients over this period of time, I am very proud of our reputation. This man attempted to steal from my company and threatened my family. He was quick to slander my name but failed to mention that this had been resolved. His file is very well documented. The memorial was neither incorrect nor late, and we have the documentation if anyone is interested. I appreciate sites such as this, however they can be used by dishonest people as a threat to bully their attemted thefts. I had my small children spend the night with friends because of his threats. This is a man that threatened the life of a family; I hope that is enough said. I welcome any contacts regarding this issue. I will be glad to send you pictures of the memorial, it is stunning.

WHY WOULD YOU SHOP OUT OF STATE UNLESS YOUR SON WAS BURIED THERE? i WASN'T VERY CLEAR ABOUT THE PARTICULARS AND I AM NOT A LAWYER SO I CAN'T OFFER YOU LEGAL ADVICE? I AM WONDERING WHY YOU HAVEN'T CALLED THESE CROOKS AT THE MONUMENT COMPANY AND TOLD THEM IF THEY DON'T REPAIR OR REPLACE THE DEFECTIVE WORK AND TAKE PLENTY OF PHOTOS OF THIS MESS, THAT YOU WILL CALL THE LOCAL NEWS MEDIA IN YOUR TOWN AND THEN DO IT --TV STATIONS, NEWSPAPERS, THE ASSOCIATED PRESS -- TELL THE WORLD! YOU SHOULD HAVE GOT A LAWYER AND IF YOUR LAYWER DIDN'T HELP YOU EXPLAIN THE SITUATION TO YOUR STATE'S BAR ASSOCIATION. YOU REALLY SHOULD HAVE GONE TO THE COLLEGE ART DEPARTMENT AND ADVERTISED ON THE SCHOOL BULLETIN BOARD FOR A SCULPTING STUDENT TO MAKE A MONUMENT FOR YOU --CHEAPER THAN ALL THE HELL YOR HAVE SUFFERED AN DARE GOING TO CONTINUE TO SUFFER WITH THIS HORRIBLE COMPANY. ALSO, MAYBE YOU SHOULD GO TALK TO THE LAW SCHOOL AT YOUR LOCAL UNIVERSITY AND SEE IF YOU CAN GETG SOME LEGAL REPRESENTATION FROM THERE PRO BONO OR GO TO YOUR LOCAL LEGAL AID SOCIETY.
