I was recruited through an ad in the Wall Street Journal that said $5,000 for 5 hours work."  The company was MND Enterprises, Inc. and Fleet Export, Inc. They were looking for people with a good credit rating to lease or finance a high-end car like a Range Rover, Mercedes, BMW, Maseratti, Porsche, etc. from a dealership using their credit card to make the down payment and the first lease payment.  They told me that they would then make two more lease payments on my $103,286 2017 Range Rover and then pay off the balance owed so that I could obtain the title to the car.  I would then sell the car to MND Enterprises which in turn would sell the car to Fleet Export, Inc. - both owned by Michael A. Downs - and the car would be sold in China for a big profit for Mike.

He failed to make lease payments 4, 5 or 6 on time after I sent him each invoice, texted, phoned and emailed him to do so.  He finally made all three of those payments.  He has not made payments 7, 8 or 9, nor has he made all of the auto insurance payments for which I have been receiving collection notices.  One of his employees advised me that Mike had arranged to have the Range Rover picked up by a trucker and had it transported to an unknown location in California.  I tried to get Mike to tell me where the car is being held and to make the lease payments and the insurance payments but he no longer answers his phone, answers my text messages or my emails.  He used to leave messages stating that "it was up to the capital company."

On November 20, 2018, Westchester Export Capital, LLC of 65 Court Street, Apt. 4, White Plains, NY 10601, filed a UCC-1 form to establish itself as a creditor and Mike and Christine Downs as debtors.  In essence, Mike turned his company over to Westchester to provide all of the financing on his cars.  They paid off some of the cars after ruining the credit rating of the senior citizens whose credit they used but they still have not paid off approximately 7 or 8 others that I know of, all of which were leased or financed the same way that mine was.  Westchester also refuses to communicate with our group.

Chase Bank provided the financing for many of the cars that were leased or financed in this way.  They want to be paid for the outstanding balances on the leases and financing or they would like to repossess the cars.  However, no one knows where the cars are being held.  I sent Mike Downs a demand letter with a copy to Westchester Export Capital, LLC, giving him until May 7, 2018 to return the car to me or I will file charges against him for grand theft auto and fraud in the inducement.  I plan to file similar charges against Westchester Export Capital, LLC.

Before I entered into this agreement with Mike Downs, whom I have never met nor spoken to on the phone, I checked out this business online.  I found that it is perfectly legal to buy a car from a dealer and sell it to a domestic company.  It is not, however, legal to sell the car out of the country.  My plan was to sell the car to a licensed U. S. auto dealer, MND Enterprises, Inc., which was perfectly legal.  What MND did with the car was their business.

The Range Rover that I arranged to lease for Mike Downs is now being controlled by Charles Brofman, CEO of Westchester Export Capital, LLC.  Therefore, on May 7, 2018 if the Range Rover is not turned over to me in the original, brand new condition that it was in when I turned it over to Mike Downs' agent, Mr. Brad Moretti, Mr. Brofman and Westchester Export Capital, LLC will be guilty of grand theft auto and fraud in the inducement.  I plan to file charges against both companies at that point.

I highly recommend that anyone reading this report should not do business with Michael A. Downs, owner of these two companies, or Westchester Export Capital, LLC, since both have defrauded me and a dozen other senior citizens that I know of - there are undoubtedly many more like us - and they have ruined the outstanding credit rating that all of have established over the past 50 or 60+ years.

Right now, Fleet export inc, Mr.Michael Downs  holding the money from many Chinese companys. The company in China make the payment and do not get the cars. Some of company already start lawsuit proccess. But right now, Fleet export inc, Mr.Michael Downs, closed their company. and  Fleet export inc, Mr.Michael Downs's bank in Arkansas. Event if you win the lawsuit, I think you can't get back your money ethier.  So hope every one who saw this post, report 

Fleet export inc, Mr.Michael Downs to police and FBI for fraud!

How did Richard M. Block verify the information that was given, regarding the relationship between Fleet Export, Inc. and Westchester Export Capital, LLC?

Who provided this information to Richard M. Block.?

 

What past dealings did Michael Downs have with Westchester Export Capital, if any?

 

Why did Michael Downs, stop paying the lease payments, when he already paid the first 6 lease payments and agreed to purchase the car? 

Why was the buyout not completed after the 2nd payment?  Why 6 lease payments or more?

 

Where did Michael Downs obtain funds for some of the other car payments?

 

Did Westchester Export Capital actually file a UCC-1 form to establish itself as a creditor

and Mike and Christine Downs as debtors?

What is a UCC-1?

What is the purpose of filing a UCC-1?

Is there a UCC-1 filed with Fleet Export Inc.?

 

If Westchester Export Capital financed cars in the past for Michael Downs, then why is Michael Downs not completing the purchase with Westchester Export Capital to pay off the lease for the car and hold the car as inventory?

Has the vehicle been reported stolen?

or has the vehicle been returned?

Who is holding the original title and why was the vehicle surrendered, prior to having the lien paid off?

Best solution is to retain possession of the vehicle, until paid in full.

Is MND Enterprises, Inc. and Fleet Export, Inc., licensed as Motor Vehicle Dealers?

If not licesend to sell vehicles, then how is it possible to sell the vehicle to them, if they do not transfer 

the title to their name and pay taxes? How is the state notified of the sale?

How can financing be available to unlicesed dealers for export?

How can WEC be involved when Chase Bank financed the vehicle?

If the vehicle was leased, then how can it be sold or have the vehicle surrendered before paying off the vehicle?

If there are a dozen victims, have all victims reported the problem with Police together?

Did you do an extensive google search and other searches on the parties, prior to entering into an agreement?

How can you enter into an agreement to sell a vehicle, that Chase Bank owns?

Never surrender a vehicle, until the financing has been paid off in full and have the title transferred from your name

to the buyers name, so that the state is notified of the sale and who the new owner is.

A vehicle is not officially sold, until title is transferred, because the state recognizes ownership of a vehicle

A re-assignment on the back of the title is not ownership, just read the fine print on a vehicle title on both sides.

May 7, 2018 - Today I received information about the financial relationship between Fleet Export, Inc. and Westchester Export Capital, LLC that completely contradicts the report that I filed about Westchester on April 30, 2017.  I was told by Mike Downs, owner of Fleet Export, Inc., that Westchester was responsible for the failure to make the lease payments and the insurance payments on the 2017 Range Rover that I was fraudulently induced to lease by Mr. Downs.  The truth of the matter is that Mr. Downs apparently failed to obtain a buyer for the Range Rover and so he fell behind in his lease and insurance payments and transferred the blame to Westchester.  I also just learned that Mr. Downs was forced to close his office in Pompano Beach, Florida in order to conserve his cash and reduce his expenses.  Mr. Downs has left a group of senior citizens holding the bag for unpaid lease, finance and/or insurance charges and has ruined the excellent credit rating that these senior citizens had established over their lifetime.

Westchester Export Capital, LLC is an outstanding financing company that provides the bridge funding for the sale of various types of capital equipment in business-to-business relationships.  It is reputed to be the world's leading automotive trade export financier, specializing in financing automotive products across the globe from one business client to another.  They have an excellent reputation in their industry.  Westchester had arranged to provide bridge financing for Mike Downs once he had access to a car and a buyer who would put up a letter of credit to pay for the car.  I am not sure exactly what happened to Mr. Downs' business that caused him to no longer fulfill his obligations to his lessees, his buyers, his employees and to his creditors like Westchester.

I apologize for having associated Westchester Export Capital, LLC with Fleet Export, Inc. in any way other than as a secured lender.  My misinformation was obtained from Mike Downs and his associates.
