Did anyone notice this statement in the original post. "4 hours later we came back to find out that our vehicle was towed away from Western Towing. That had been authorized by a member of the HOA" Doesn't it read like the Home Owners Association either called them or at the very least authorized it. It doesn't look a random towing to me. Might want to discuss it with the HOA.

Steve> Good on you for taking them to small claims court. I hope you share here how it comes out. These scam ( scum) can't find a light way to make money, so they prey on individuals and try and make persons think the law is on their side. look into the law about towing from private property, I would bet they did not follow things to the letter ( like contacting the owner of the property, or being contacted by the owner of the property) prior to towing your car. some months ago a similar scam was going on at a mini mall, the towing company got fined, and the owners got jail time. do your research before you get to court, these slobs need to be taken to task. ( maybe get the property owner as a sub defendant on the small claims case, bet they won't even show up)

We went this night to pay for our vehicle to be released from their yard on 7182 El Cajon blvd - a total 46 hours after it was towed away, all wasted in futile attempts to resolve the issue. Western towing charged for 3 full days of storage (3x$35) - they, you know, do not pro-rate!!!
