Westgate uses fraudulent selling practices and violates basic contract law. Westagte represents material facts to potential buyers during the sales tour and states the contrary in the Purchase Documents and Public Offering Statement (POS), represents material facts that cannot be verified during the cancellation period (the 10-day cancelation period is purposely not disclosed during the sales tour), insists on having the purchase documents signed prior to be allowed to read all contents. There are 3 major elements to a contract (1) the agreement of the contract, (2) a meeting of the minds, and (3) consideration. Agreement implies that the parties to the contract first understand one another and both agree to the same terms, that neither is under mistake of fact which goes to the very root of the contract. A meeting of the minds involves the complete agreement in that neither party to contract will have thought that any element critical to the contract will have believed anything other than the other contracting party. Consideration involves giving a value to the other contracting party. Westgate did not allow agreement of contract and meeting of the minds in our transaction because Westgate gave us false information and intentionally concealed information from us during the sales tour, and refused our requests and right to read the entire content of the Purchase Documents (which is contrary to the verbal information received during the sales tour) prior to signing the documents. Westgate declined our requests to read the Purchase Documents prior to signing them constitutes an infringement of our right to do so and a fraudulent scheme used by Westgate because most of the verbal information conveyed during the sales tour does not concur with the written information in the purchase documents. Giving false verbal information during the sales tours is not a one-time incidence experienced by us, but practiced routinely and experienced by other potential buyers.

Westgate does not communicate properly with buyers/owners. They promise to send documents, but never do, they give wrong and inconsistent information, and they use this as tactics to prevent you from canceling the contract.

Westgate released our private infromation to a potential buyer and reported our account to collection when it was in good standing.
