where do i start? a year ago i applied for a title loan through wilshire consumer credit. i have never missed a payment and have always paid on time and always paid a few dollars extra towards my payment. in december i was told that i would be able to miss one payment  and all i would need to do is pay the 50 dollar fee to grant that missed payment. i paid the 50.00 dollars and assumed december was paid for. id december i was in the hospital having surgery and noticed i had a few mised calls from wilshire consumer credit. i called them and they told me that i missed  payment. i told them that i paid the 50.00 fee and that i was told i could miss december payment. they said they would take care of the issue and that my payment  for december would be updated. i again got a few more calls and again told them about the 50.00 fee and they still had not resolved the reason as to why my payments were not updated. later that month and beginning of january i lost my hearing. i had two ear infections and was not able to make phone calls. i again noticed that they called and  later in january when i could hear again i called them and they told me i was now two months behind. i told them that was not correct and that i was allowed to miss december payment. they then told me that the 50.00 fee was not paid for that my bank did not cover it. i was not aware of this. i had payments arranged to make january payment and told them i would be able to pay for january by the end of friday and they told me they would note it and i asked them if my car would be taken and they said no and to make sure i paid on friday. i went to get my son from school today and my car was gone. no notice that they took it and to make things worse. my walker is in the back trunk of my car and i have no way to go and get ir or make the payments. i now owe 12387.82 and if its not paid they will send it to auction. they know i am on a fixed income. that i only get paid twice a month. they know i have no way to make the payments requested and i feel that their company is injustice. i have never missed a payment and always paid on time. 37 days late and they are allowed to take my car without me knowing. i need help! what can i do to sue them? and how can i get my car back and never again will i be working with wilshire consumer credit.

You show the classic Entitlement mentality.  As you not only missed December's Payment, but you missed January's as well.  Yet you want to sue them.

Now, your excuse for December is that you said that they said you could skip it if you pay $50. However, your bank rejected the payment and you failed to monitor your bank account to make sure it went through.  Yet again..it is all their fault.

Even if we take December as a "mistake", you fully admit you are delinquent with January.  So yes they have every right to repossess your car, and you gave them this right when you got the loan. 

But then of course you say something like "Well they said they weren't going to repossess it".  Okay, so if they told you they were what would you  have done? Would you have paid them or hide the car?  If you would have paid them why do you need the threat of a repo to pay?  If you would have hid the car what does that really say about you.

By the way, even though you keep saying you always paid on time is an outright lie.  You have so far missed two.

Here is how you get your car back...pay them $12,387.82.  Or less if you can get them to agree to it.

But if you for a moment think you have a valid lawsuit, you are not only on physical disability. but a mental one as well.
