HI! Our names are Albert and Sara and we are victims of the mortgage game that is going on right now with Wilshire, and this is our story. We found our dream home in a little town in Idaho, a beautiful 5 bedroom 3 bath home that was 3600 square feet. Plenty of room for us to start our lives being foster parents and hopefully being able to make some childrens dreams come true of having a family. Wilshire has taken that away from us.

In the summer of 2007, we fell behind on our bills, Albert got sick and I was traveling over 100 miles each way for work. We contacted our mortgage agency, Wilshire, for any assistance we might be able to have. We were told that we could put in a hard ship forbearance to help us out. We faxed this paperwork to them over 4 times. They kept saying they never received it. We then sent it to them via certified mail 2 times and still no response. By this time it was fall and we could no longer make the mortgage payments. When we could no longer make the payments, we put the house up for sale. This then brought us just more tears, and headaches. We thought we had already been put through everything we could possibly be put through but it just continued. We had absolutely no offers on the home last fall, and in December we moved closer to my work and closer to healthcare for Albert. In the winter of 08 and into the spring of 08, we kept the house listed. When we moved out in December, we could only take the bare essentials with us due to high moving costs and left 75 percent of our things in the house. We got an offer in February, that would pay off the mortgage and give us the extra money we needed to finish moving, only to have Wilshire drag their heels and never respond to the title agency, the bank, everyone. It was like they never were contacted, we could get no response from them. That deal went south, and we were devastated. We could never get a pay off amount from them, they were contacted by several different agencies regarding the amount owed. We were ball parking the figure to be somewhere around 92,000 due to an early prepayment penalty. We finally received a letter for the pay off amount around 6 weeks after it was needed only to find that they were charging us around 1800 a month in fees. We subsequently have had 3 more offers that have all not gone through due to Wilshire not getting back to people at all. We went from owing $88000 to almost 100,000 due to them dragging their heels. But our story does not stop here.

We got an email from our agent this last week telling us that she could not get into our house to show it; it is still ours until the 27th of August. The mortgage company broke into our home, changed the locks on the doors, and padlocked our shed. They have essentially locked us out of our home, our belongings are still in the house, our shed is full of our belongings, and we are unable to get into the home to see what has been taken. They have committed a crime!! Not only have they committed breaking and entering, they have committed grand theft, and they have impeded the sale of the house several times. We are represented by a lawyer who wants to hear from you!! Do you want to be part of a class action law suit against Wilshire? Join us now!!!

Hello, I am so sorry for what you have been through. I have seen ever single problem known to man why people have lost their house. I know that losing a job, a sickness, living way over ones means will certainly be a factor in one not being able to stay current and at some point people throw up their hands and leave their homes. Many people take out loans that they should not have, putting nothing down, taking out ARMS, buy a house full of new furniture, use credit cards contstantly, have car loans and it is almost imporssible to do all of these things and not be in a financial bind. I am not saying at all that some of these were a factor with your situation, but they are just a few things I see on a everyday basis and many times they blame the Mortgage Company for their un wise use of finances. When you moved out and were late on your payments yous LEFT your house vacant. I contract for many different mortgage companies to inspect houses and often times they are left vacant. You would not believe what I find once the house is vacant. I see houses that are absolutely destroyed by vandals and many times homeless people move in. I find drug parphanalia on the floor, carpet burned where they had been using drugs on the floor. I find dead animals from people who have abandoned their pets and left them with no food or water to just die. I find holes in walls, sometimes I have found NO walls left because of either the homeowner took out their anger on their house before they left or vandals came in and totally destroyed the house. So it is not that we are changing locks just to be mean and lock yourself out of your home, but once you leave that home you gave up whatever was left inside. You should have taken with you what you wanted or stored it in a storage company. I have seen things that would have shocked you and I do not think you would have wanted for us to just let this happen to your home. The mortgage company did not break into your home, they are securing the property that you left. At some point this house must be in good enough condition to sell and I think you would want it locked up and in the condition you left it in and not destroyed by someone who broke in and vandalized it. I inspected a house just this week that has been vandalized and after inspecting it there is no way this house is in marketable condition to sell it. Surely this is not what you wish for your house. I realize this is all a highly charged emtional ride you have been on and so I am not explaining this to sound mean, but to explain the other side a bit. People do not realize we find houses with 4 feet of grass and higher, a house that when people know it is vacant think it is fair game to just destroy. Most people do not hire anyone to care for the property and just this week i found fleas and snakes in the grass that was so high I could not even get to the front door. This was not in a lower income area, this house was well over $300,00 and in a very nice area. Yet the owners had moved out and was not paying anyone to care for their home and it is becoming a target in he neighborhood for vandals. So perhaps this will explain a little bit more about why when people move out on their homes the mortgage company does NOT break in your house, we are now SECURING their property. Until that house is paid in full unfortunately the mortgage company still owns that house and they need to keep it secured. Thanks for your time and again I am so sorry for what you have been through. I have alot of pride for foster parents and work with them, so I know you had to have been devastated when you lost your home. My prayers are with your family. Cat

You could have filed BANKRUPTCY and protected your home and belongings. You made a series of bad choices. No ripoff here.

First I want to say that I am sorry for your hardship. I truly hope things get better. I want to let you know that by law and by your contract that you signed if you move out of a property and it is not occupied by anyone or rented or etc. We have a vested interest in your property and we will put a lock box on your door for protection. We did not break into your house, we prevented someone else from doing so. As far as the fees go on your account, if you pay outside your grace period you are charged a late fee that is allowed on your contract. If we are unable to reach you or have any response from our letters or phone calls then after 30 days we send someone to your house to try to talk to you to work out an arrangement. This is probably how we found out the home was not occupied. When we send out a notice of intent after 35 days delinquent we charge a bpo which stands for brokers price opinion.That is an appraisal so we know the fair market value on your home in case it goes to foreclosure. These fees can really add up. It may seem like we are adding on all these fees but in fact we are only abiding by the contract you signed. It is not like we are adding all these fees to make things worse. As far as you not being able to sell the house I am sorry for that. These are some really hard times for people. I wish things could have went better for your situation. As far as contacting a lawyer I sincerely hope you consider that we have done nothing wrong and paying an attorney to find that out would be a very frustrating and expensive lesson. Any lawyer will take your case if you pay them a fee. Good luck with your situation. I really do mean that.
