Below is the emails between the scumbags at www.xtiusa.com. They like to post unusually low computer component prices on nextag.com, pricegrabber.com, etc. as a way to lure people into their scam. When you go to order the component, they make you call them so they can try to push loads of extra $$ things you don't need, or want. If you don't play their game, they cancel your order, and give you a lame excuse.

You absolutely have no right to abuse and harass us by calling bullshit artists and by calling us fake price scalping bastards. Also, it is illegal and against the law to do such a thing verbally or through electronic mail, which is what you did. This is called slender. These email harassments will be forwarded to your local police department. It looks like you don't know the law.

The fact that you have used this card for as long as I have been with the bank that backs it doesn't prove that your billing address is verifiable. You bank may very well back it but it might've also failed to arrange for proper address verification process. There is no connection between these two matters. Your bank may be backing it up but we must verify this from our end which is impossible to do. This is called internet order processing security procedure and you may not be familiar with it. This is probably a debit card and they have their own rules and regulations which make it hard for vendors to process those cards. Whatever rules and regulations they have, we have no control over them and it is not our fault.

On the other hand we have documented proof that your billing address is unverifiable.

You provided billing address that is not verifiable and wanted the product to be shipped to unverified billing address. This automatically tells us that you tried to commit a fraudulent purchase.

By law we're not obligated to ship the merchandise to unknown or unverified billing address.

In fact, by law we're not obligated to complete the order with you under any circumstances. It is at our own discretion, whether or not we decide to process your order.

Since you're so persistent and obtrusive in trying to apply pressure to the way we process orders and to the way we conduct business that we must be very careful in processing your order. This whole situation looks like a fraud.

You're threatening us with all kinds of Better Business Bureau, Consumer Protection and Attorney General head to toe investigation and trying to convince us to ship the product to unverified billing address. This is called extortion by threatening.

ALSO, PLEASE REMEMBER WE NEVER ENTERED INTO ANY KIND OF CONTRACT WITH YOU AND NEVER SIGNED ANY PAPER IN WHICH WE ACCEPTED ANY OBLIGATIONS. WE NEVER CHARGED YOUR CREDIT CARD, SO WE DON'T OWE YOU ANYTHING.

Also, our website clearly states that:

We reserve the right to limit quantities sold, including the right to limit or prohibit sales to dealers, households or individuals. Prices and availability are subject to change without notice. Errors will be corrected where discovered, and XTI USA reserves the right to revoke any stated offer.

At this point we feel that we didn't do anything wrong or illegal and kept our part of the bargain. It is you who didn't provide correct billing information and/or correct credit card number. There was no transaction between us and you and no contract that would've obligated us to transact with you. At this point in time from the legal point of view this transaction looks like a scheme. You made a false representation of your credit card and/or billing address and yet insisting on processing the order. By not being able to verify your billing address and your name with connection to this address we then don't know it is actually you who placed the order.

Therefore your NYS AG complaint has no grounds whatsoever. Period!

This issue was never resolved: I would call your Attorney General, if you are having problems. SOMEONE CALLED MY FRIENDS HOUSE WITH THIS ?: "I read a report about a bad experience you had dealing with XITRON USA I wonder if you ever managed to resolve the issues raised in that report I too am going through a rather bad experience in dealing with this company after ordering an item from their listing on AMAZON. I would like to hear from you".
