I gave the rent check to the office on the 2nd of October it wasnt cashed untill the 18 of the month which put my bank acount in the negative for 770.00, as i am totaly disabled and live on 1304.00 a month it is im possably to pay the rent being that far in the arears after the bank took the money i had less than 600.00 to live on for the month. And now they've giving me an eviction letter I dont know what to do maybe you all can help thank you.

 If you can't afford it. You had plenty of time to move. You can't depend on others. You're an adult so act like one. Life is hard for all of us adults. You're making better money then me. You can move to a low income housing. I'm surprised you live there.

I used to live at this community with my family several years ago. They have a roach problem there. That place should be income based. See if you can get a part time job in the mean time. You have enough for extender stay move there

This complainant received a 30 day notice for his failure to pay October's rent, his recollection of a check not being cashed in a timely manner was actually September's rent payment which was taken care of back in September. The complainant completed a 'Promise To Pay' by Saturday, October 18th and as long as this resident pays his October rent in full he will not be evicted. We do believe this situation has been resolved in an amicable manner and that this complainant as no further issues or concerns. If you knew the truth you wouldnt be so quick to judge the money was there when i wrote the check the fact that they cashed it two weeks later , is what put me minis 770.00 try living on 1300.00 dollars a month and going to a food bank every week so my wife and i can eat, god thank you for the food bank and my wife

 Sorry but there is one person and one person only to blame for your situation..YOU.

You seem to have a misconception of what a check is.  A check is NOT some piece of paper that you write someone but if they don't cash it within a few days the check all of the sudden becomes void and they no longer can take the money out.  A check is a legal promise that you made to the company to give them a specific amount of money.

When you gave them the rent check, that means that money is no longer available to you.  Had you kept a written register you would have written the check down and known you no longer had that money available.  It doesn't matter if they cash it 1 day or 1 month after you gave them the check, the check says you are allocating that amount to them.

The fact that you spent the money before they had a chance to cash the check, is not their problem.   Hopefully the Eviction notice gives you a chance to respond, where you can try to plead your case about how they didn't cash the check quick enough...but don't count on it.
