Proof of Payment

I leased a Jeep Cherokee back in Aug 2019 from Sterling Heights Dodge Chrysler Jeep and Ram located at 40111 Van d**e Ave. Sterling Heights, MI 48313. Ally was the bank that held the financing for it, which was setup at the dealership. It was a 2 year lease.

At the end of the 2 year lease, we had the option to extend it for 3 months. We took the option. Ally mailed an extension agreement which I signed and mailed back. I continued to make the payments for the extension. Some time in month 3, Ally called and stated that they never received the contract but have received the payments. I asked that they resend another extension contract and that we extend for a final 3 month period that would ultimately expire Feb 15, 2022. They said that was fine as long as payments stay current.

We continued to make the payments and went back to the dealership on February 8th to just purchase the vehicle outright. The Finance Manager Denise, after having me wait for 45 minutes, calls me in to her office to have me sign the purchase docs. As I'm sitting reviewing them as she is pushing me to sign, I realize that they are trying to charge a 6.1% interest rate!? My credit score is over 800. After letting them know that was unacceptable, I went to my bank to have them finance the purchase.

My bank was able to provide the loan at 2.99%. I went ahead signed the docs and that same day, my bank mailed out a Cashier's Check to Ally Financial (see attached). On February 14th, I woke up to leave for work and noticed that my car was gone! I called the police to realize that the car was repossessed. 

At that moment, I called Ally Financial. The first representative told me that they don't see that the car has been repossessed, that payments were current, and that I needed to talk to another department. I was transferred to another representative... Representative number two literally told me the same thing and said that I needed to talk to another department... Representative number three confirmed what representatives one and two said and then said that I needed to talk to yet another department?!?

Finally at representative number four they were able to see that the car was indeed repossessed. At this point, the representative became confrontational even though I was trying to provide proof of payment and it was clearly in their system that payments were current! They said things like" surrree your bank sent the payoff."

Today is now February 15th. I had my bank send a letter and proof of payment to Ally and now Ally is saying that the payment needs to come from the dealership. I called the dealership and the dealership, specifically Gary Riashi, said that was false. The dealership does not have to be the party that sends the payment.

Now I'm stuck in the middle, without a vehicle to go to work, between Ally and the Dealership as they point the finger. Now Gary Riashi is stating that it is out of their hands and do not want to provide any support even though Ally maintains that it is them. Truly, both are at fault with Ally now holding the vehicle.

What a disaster!!! They not only have all the funds but they still have the car with no end in sight.
