Legal malpractice 

 

Attorney acted as my attorney and accountant 

·      No forensic evaluation was ever done in case

·      No deposition was ever done in case

·      There was no discovery and case still went to trial

·      My attorney decided to use quickbooks without actual data file, nothing from quickbooks was never summited into evidence.

Conjoining 3rd parties to case (brother and sister used in hidding Community assets)

·      Title of deeds, transfer of community among siblings where never presented in Court (hearsay)

·      Text msg of millions of community funds transferred aboard not presented in court

·      Affidavit sown by my dad over ½ million $ on work done for property above, never provide to court 

·      Refused to allow my dad to have a telephonic appearance to describe property abroad bills during marriage

·      Never subpoenaed loan company for funds that we are taking outs of family property during marriage over half $1 million

·      There was never an appraisal for property, or that Party used a comp price to determine the value of the property

·      Renovations pictures taken for property here and abroad whenever presented to the courts (Even though I had most of them on my iPad)

 

 

Suppressed evidence

·      Proof of service filed by (myself) legal separation (to determine date of separation) never provide during trial 

·      Other party send about 90% of time aboard, attorney refused to summit passport copies during trial or subpoena Travel Agency

·      Other party had million dollar contact from aboard, during preparation for trial, I constantly demanded his seeks requests for “ freedom of information act to determine payments abroad” I provided attorney with multiple leads, also provided him with an attorney number to call, also no Advil

·      Court rejecting attorney filed documents, due to failure to meet filing deadline, 2 filing where rejected

2.   During Trial 

·      Attorney refused to respond to ex parte ( after judge decided to give extra time to be back to court) which led to my spousal support suspended

·      During trial again attorney doc where reject, for not filing properly

·      Refused to summited my FL150 (income and expenses declaration) after I made corrections said he will not summit, nothing was ever filed for trial 

 

Duration of marriage

 

·      Destroyed evidence for traditional marriage abroad 2002 instead of 2005

·      Never produced the album to the Court

·      Could have used an expert from country to define if it’s traditional marriage is legal in country

Presented of false documents to court

·      Presented paperwork to court, after I told attorney paperwork was over 10 years of no use

Preparation for trial and mediation

·      Attorney never prepare client for mediation or trial

Never allowed me to use any of my witness in court during trial

 

Seems to have been deliberately setting me up during trial, avoiding questions and giving me false response to destroy my case (letter to other party, “seeking attention)

 

Never presented a proper exhibits list to the courts and continue so insists he will not allow me use iPhone and iPad in quotes even though all exhibits we are presents

 

Never confiled with any of my previous attorneys (totally misleading the court)

Child diagnosis presented to court

I have been a stay at home mom, all through marriage with a special need son, attorney never presented diagnoses or IEP Document to court, other party denied child is ok. Never presented to the court, I was living like a single mom

 

Secrets condominium property outside of marriage

I continuously demanded pre-trial for my Attorney to seek reimbursements for the secret condominium position I had during marriage, attorney continue to insist this will harm my case, my attorney words were “ the court will say you knew he was cheating on you” as such never presented to the court, the other party was living a double life, and during the marriage was able to afford to runs 2 home simultaneously

 

My conclusion my attorney seems to have been compromised, by my ex who is equally an attorney

Allowed trial to proceed without my side of the story, the judge only had one side of the story.

 

Failure to perform conflict of interest Check

Conflict of interest, my attorney had a client as well who was also working for my ex. Also other sides attorney, was a friend and we both attended his wedding and has visited our house (multiple pictures)

 

No fact checking ever done by my attorney.

 

Medical issues

 

I had two surgeries in 2019, both under aesthetic, yet my documents where never provided to court, after so much pressure to my attorney, it was mentioned hearsay, actual Paperwork of surgery we never provided.

But The other Party Who was now collecting disability income ($10,000)  had a surgery with Sedation (Still very conscious) yet spent 3 days of presentation to court, and brought in various doctors to testify.

 

Because other parties has properties and revenue coming from abroad, I had a declaration of an attorney from abroad and decided she needs to be paid to join case, after The courts awarded my attorney fee, I insisted and we need to part to attorney aboard, never got a response my attorney decided to keep all the funds

 

 

Sending out documents without my consent, which was very confusing to me during trial, as Attorney had send out documents to court with my photocopied signature.
