Michele, It is best to never even talk to any third party collector on the phone. Do everything in writing. You should send a "Cease Communication" request to them as per your right under the FDCPA. Send it certified mail, return reciept requested, and be sure to put the certified# on the letter itself before mailing, and keep a copy for your records. Also, be sure that a debt is not past the legal statute of limitations in your state which is 4-6 years depending on the type of debt in GA. Any payment you make restarts the SOL and the 7 year negative reporting to the credit bureaus. Forget the BBB, they are a corrupt and useless organization and have absolutely no power to do anything. You are entitled to $1000 per violation plus costs when someone violates the FDCPA. You can easily sue them in Federal Court. Get a police whistle, and blow it in thier ear next time they call, and then hang up. You DO NOT have to ever speak with a debt collector. You are ALWAYS in control over the decision to make a payment and how to make it. Debt collectors are absolutely powerless, despite the [illegal] threats, and they know it! Good luck~
