I took out a $150 Loan with this company, with a due date of 10-10 of $195, On October 5th I called and e-mailed this company to debit the $195. They totally disregared my instructions and took out $45, with a new date of $195 due on 11-14-07. then I found out they tried to debit my account on 11-9-07 for another $45, so I called and told them I froze my account, because I got unauthorized charges from there sister companies, I think they are selling my personal infomation. I called today 11-9-07, and told them I would send them a money order for the $195, and they said they couldn't do that, but I won't ever give my new account info to these crooks. Not only was my loan not due to 11-14-07, they are trying to debit my account early, these crooks have no morals or conscience. I am on social security and needed a loan to help my daughter. Now they say its going to collections and I owe another $30. They are refusing to let me send them a money order, so I will get a lawyer, plus turn them into the attorney general of nebraska, and neveda, as well as the FTC and who ever I can contact. I have been through hell, changing my account and Social security, so now I am going to put them through a little hell to.

Mike, Let me tell you, I did not intentionally go on and take the money and run. At the time, I thought these guys had every right to collect, but after doing homework and understanding more about the laws on payday lending, these guys are illegal after all and why should I pay. Yeah I borrowed and spent the money..OK. But the fact of them allowing us consumers to get a loan from them with no license is terrible and beign charged horrible fees, more than what AZ law allows. These guys must be shut DOWN! I offered them the priciple amount, they demanded I pay the full 400. After that, will not negociate anything else as I will not deal with unreasonable companies... If AZ law says I do not have to pay, then thats good then no more of my hard earned cash goes to these illegal crooks.

since you know it is allegedly illegal, then why are you even borrowing from them? Why aren't you borrowing from a legit bank? They won't loan to you will they? Didn't think so. You also agreed to the terms of your overpriced loan - suddenly YOU can't pay it back and it must be their fault. Loser. I don't agree with the terms from these type places but it's not hard at all to look up these terms before borrowing the money. There is even gong to be a dedicated website for all you crying about screwing yourselves. Once that's up and running, then what are you going to do? Who will you blame then?

So you borrowed money from a company knowing it was illegal to do so? Who is the criminal here? I am no fan of pay day loan-sharking places but it seems to me that you borrowed money from these whores knowing that they couldn't collect on it. Just my observation. Feel free to prove me wrong.

I had a loan from Ameriloan and they actually are located in Miami, OK. A lot of people do not know that a majority of internet payday lenders are illegal because they are not licensed. In the case of of Ameriloan....this is the case in AZ and all the other states. And the fees they charge 30 bucks per 100 is illegal in AZ as well. Their Final Collections Dept called me yesterday and demanded I either pay the 400 on a 250 dollar loan or further collection action would be taken. I told them in AZ they are not licensed and by AZ law, I do not owe them a penny. The guy said I voluntarily went online and agreed to the contract voluntarily. But I countered that the contract is bound by the laws in the state where the person is taking the loan out is located. In the case of Arizona, Ameriloan is not licensed here and according to AZ State Law, they can not, again they can not legally collect from you. Here is an excerpt from AZ revised Statutes 6-1262. Violation; classification; individual liability A. A person that provides deferred presentment services without a license is guilty of a class 1 misdemeanor. B. A licensee that violates this chapter or the rules adopted pursuant to this chapter is subject to revocation of the licensee's license and is guilty of a class 1 misdemeanor. C. An officer or agent of a corporation or association who participates in a violation of this chapter is subject to the penalties prescribed in this section. D. Except as the result of an accidental or bona fide error, if the licensee charges, contracts for or receives any amount in excess of the fees expressly permitted by this chapter, the deferred presentment is voidable and the licensee has no right to collect or receive any fees in connection with the deferred presentment transaction. Any deferred presentment transaction that is made by a person who is required to be licensed pursuant to this chapter but who is not licensed is void, and the person has no right to collect, receive or retain any principal or other fees in connection with that deferred presentment transaction. Note the first sentence, providing payday loan services in AZ without a license is a Crime! So Ameriloan by allowing us to borrow and not having a license to do it, it's a class 1 misdemeanor. Also, look at section DIt says anyone without a license is not able to legally collect any principle or interest. Therefore the debt is void. If you paid these people back with interest that is higher than what the state allows, you could technically get your money back. I am thinking of starting a website for anyone in AZ who has been customers of this company and getting all the people along with me to file a class action lawsuit against this company seeking damages and hopefully shut them down I will keep you up to date of what my actions may be....
