Arash Shirdlel Santa Ana attorney and Carlos Padilla of Garden Grove loose fight to dismiss 40 Million Dollar Law Suit.
Defendants Arash Shirdel a Santa Ana attorney and his client Carlos Padilla will stand trial in the superior court for 40 Million Dollars in Damage for slander, along with Fraud on the Courts, Mail Fraud and the intentional demise of the company WECOSIGN, where Frank Jakubaitis, plaintiff was the former CEO according to the complaint filed.
The Superior Court found that in spite of 650 pages of documents filed by Arash Shirdel attempting to defend himself and his client Carlos Padilla of garden grove, the court found that sufficient evidence existed to bring the pair to trial overuling the demurrer in its entirety filed by Shirdel and Padilla.
The Complaint in Superior Court alleges that the pair conspired with others (yet to be named) and posted false and slanderous remarks on the Internet defaming Jakubaitis and his wife over the past year after Padilla was fired from the company for general dishonesty.
The two (Shirdel and Padilla) simply went on a smear campaign and began writing false and misleading stories to investors, customers and vendors and the general pubic says Jakubaitis, eventually bringing about the demise of WECOSIGN a company that Jakubaitis founded 6 years ago that is now in Bankruptcy as a result of the false postings.
The complaint alleges by affadavit of neighbor witnesses that Padilla also approached the neighbors of Jakubaitis and attempted to further disparge his wife . Padilla could not be reached for comment as he failed to show up at the initial hearing with Shirdel.
Shirdel is self represented as is Padilla. Padilla won a judgement aginst Jakubaitis earlier this year however the file is up on appeal at the California appelate court as the judgement was obtained by submitting fraudulent documents to the court by Padilla and Shirdel according to the complaint.
