finance manager and salesman told me to voluntary give up my vehicle for trade for repsession and by another car. leaving my car with then in storage w/keys because they didn't want to give me the trade value for my car but before i let them have the car SAM THE FINANCE MSNGR. told me they would pay for whatever debt owed on car after they sold it,and i believed them. when i received what was owed i imediatley sent the manager the debt letter assuming they would follow up on there promice. later after about 4mos. i called auto gallery imports and the finance manager didn't work there anymore but the salesman was aware of the whole agreement. i have allthe letters i faxed to them. dec. 2017 will be two yrs they lied and was criminal also.

I believe that the sales rep and the finance person told you to have your vehicle repossessed. It is common knowledge that that vehicle sales reps and finance people will say anything to get you to buy a vehicle. Was it a lie - of course it was. That is what auto sales reps and finance people do...they lie.   I don't condone their actions, however, it is on you to protect yourself.

Looking at their statements, as you told us in your post, that they would pay the debt owed after it was repo'ed makes no sense on its face. If they asked you to suffer a repo on your credit, why would they "pay the debt" after the repo?  There is no written contract between you and the dealership for them to pay it, is there?  The damage is done when the vehicle is repossessed - and as Robert pointed out, it is long term damage to your credit.

Just because someone asks you to do something harmful to yourself and your credit doesn't mean you have to actually do it. You can't blame them for asking ...even though it is a cheezy thing to do. But look to yourself for actually following through on their bonehead suggestion. I bet they are laughing all the way to the bank....

So you are going to come onto a PUBLIC site and basically tell us that this dealer told you to do a Voluntary Repo and that sounded like a good idea to you?

If what you are saying is true, then they got you good and probably saw the "sucker" sign hanging above your head the second you walked into the dealership. However, regardless of if they told you to do this..in the end it was YOUR choice to actually do that. So if there is any fraud or criminal acts being comitted here it was done by you. Not to mention that even if they paid it off you would be stuck with a reposession on your record for SEVEN years.  I guess you can hope that the probably 10+ year old car you got stuck with that has with probably well over 100K miles lasts you another 5 or so years so you don't have to try and get another auto loan.  

Of course if you say they haven't paid you then you can always sue them for the money.  I am sure the judge will have no issue with your claim and would love to see the papers you faxed over to them. Let us know how that goes.
