Hello. I am in the same boat as you i guess. I voluntarily had my 2006 Ford Explorer repoe'd in 2010. I was told to continue making the payments, which I could not afford. After about 7 months of paying very much reduced payments, I stopped paying. Because the interest that Wells Fargo Auto Finance was charging was NOT making the balance lower, it was making it higher. So I stopped paying. Never heard anything from anyone until 2 weeks ago. I got a summons from our local court that Autovest is suing me for nearly $18,ooo dollars. I have never heard of Autovest until I looked them up after getting the summons. Scam artists.
However, I still have this lawsuit hanging over me. I've given my answer to the court as I had to. Now awaiting the hearing if any.
After my truck was repoe'd, I recieved not one piece of evidence as to if the Ford was resold, how much sold for, who purchased the contract, nothing. I recieved NO paperwork at all. I read that that I was suppose to recieve all that. I didn't .
I don't make a lot of money, i'm on part time. My wife is on dissability. I'm 60 years old. I have no bank account to speak of. Maybe $100 in my account.
Our home is paid for. It was inheritance to my wife after her mom passed away. New Mexico law states that our home can't be taken from us.
We have one vehicle. A 1995 GMC pickup that's paid for. It's all we have.
Can I 'win' in fighting this? Is there any way of getting this dropped???
