Back in the early part of 2006 we bought a Trailblazer.  Two months later the vehicle got wrecked and totaled out.  We had purchased GAP insurance on the vehicle.  So between our full coverage insurance and the GAP insurance the loan should have been paid in full right?  Yeah well not according to Fifth Third Bank.  I got a letter from them a few months later stating that we still owed them five grand.  I called them and they tried to tell me that the GAP insurance didn't cover the amount still owing on the trade that we used.  Well that's not true according to the GAP insurance company.  After much wrangling back and forth it was determined that we still owed a few payments that were owed inbetween the time it got wrecked and when the insurance paid out etc.  Fine.  I sent Fifth Third a check.  A year later I heard from Servicing Solutions.  They say that we owe $3600  We sent them a letter disputing the debt.  fast forward another year and we hear from a place called Michael Andrews and associates they say we owe them $1400.  My husband was deployed at the time and since the debt is in his name they refused to speak to me and just started making threats about taking us to court and garnishing his wages.  We didn't hear anything until early in 2012 when we heard from Autovest still claiming that we owe $2500.  This debt is not on my husband's credit report except for a closed account from the original creditor.  Now we have a sherrif's deputy at the door with a court summons for him to appear in court.  

I don't know what the amount they are claiming this time is but we don't have any of the original paperwork anymore.  Are we going to be just screwed for whatever number they decide to pull out of the air?  We are a military family in the middle of trying to prepare for a PCS move halfway across the country.  What do we do now?

Hello. I am in the same boat as you i guess. I voluntarily had my 2006 Ford Explorer repoe'd in 2010. I was told to continue making the payments, which I could not afford. After about 7 months of paying very much reduced payments, I stopped paying. Because the interest that Wells Fargo Auto Finance was charging was NOT making the balance lower, it was making it higher. So I stopped paying. Never heard anything from anyone until 2 weeks ago. I got a summons from our local court that Autovest is suing me for nearly $18,ooo dollars. I have never heard of Autovest until I looked them up after getting the summons. Scam artists.

However, I still have this lawsuit hanging over me. I've given my answer to the court as I had to. Now awaiting the hearing if any.

After my truck was repoe'd, I recieved not one piece of evidence as to if the Ford was resold, how much sold for, who purchased the contract, nothing. I recieved NO paperwork at all. I read that that I was suppose to recieve all that. I didn't .

I don't make a lot of money, i'm on part time. My wife is on dissability. I'm 60 years old. I have no bank account to speak of. Maybe $100 in my account.

Our home is paid for. It was inheritance to my wife after her mom passed away. New Mexico law states that our home can't be taken from us.

We have one vehicle. A 1995 GMC pickup that's paid for. It's all we have.

Can I 'win' in fighting this? Is there any way of getting this dropped???
