Back in July when i was out looking for a new gym because i thought my 24 Hour Fitness one was kinda expensive so i landed onto Bally's gym. i checked it out. it seemed alright but i wasnt so sure yet. so i go online to their site and found out that i could win a year's membership free of charge.

i entered not knowing anything and a few weeks later a representive called and said i won a prize and for me to go to the gym to see what i won. so i went and found out that i won a 2 weeks membership. and i also talked to the manager there. as usual he did his "sales talk" and trying to act casual and cool.

after finding out that bally has the same price as 24 i decided to keep my 24 membership. i told the manager i was a marine and that i might be on and off leavin the area so a membership might be out of the league. he was like well they got this 30 days trial membership for $5. seem very interesting and i thought it was a good deal back then. so i applied. he told me i could cancel anytime. and that after 30 days if i wasnt satisfied theyll refund my money. it was just only for 30 days i thought.

i gave him all the information. signed some papers i didnt read but he assured me it was only for the trial membership and just to get to know me type of papers. so as the time pass. i started to dislike ballys. always crowded. not enough equipments and it closes like at 9pm. so i stop going and sent them a canceling email. 2 months pass and i never got words from them so i assumed that my account was canceled until a friend of mine told me on how i can look up my credit online for free.

so i went and look it up to see if i had good credit or not and to my surprised Ballys was on there saying i owe like $1000+ and that my membership was still actived and running fine. i emailed them saying that i canceled and all this stuff but they all keep telling me the same thing abuot how im suppose to use the gym 12 consecutive days out of the 30 in order to qualify for the cancelation.

i was shocked. and not just that but after the 30 days that it would go onto a full 36 months obligation contract. so now im trying to figure out how i can cancel because everytime i talk to their so called representative they keep on telling me the same thing over and over again and its starting to piss me off to the point i want to sue but probably will not win the case.

This is easy Tony. Call Bally's and inform them that your cancellation was valid and that they are to remove the debt from your credit report. If they dispute your cancellation, don't let them argue with you; tell them that you cancelled and that's final. Inform them that they will never see a penny from you until they win a judgement in a court of law and that if they do sue you that you will countersue them. Don't let them try to convince you that this will all go before arbitration; if they want to collect from you they must go to court.
