Well just to follow up. I got a chance to speak with a Executive at BOA on Friday. He was just wonderful!! He checked out my daughters story and found it to be the truth. He promised that within 5 days all negitive readings with chexsystems would be removed. This man was just a wonderful person and we can not thank him enough! He was located in North Carolina and it was just a relief to know that there are people within the company that can help. We will follow up with chexsystems in the coming week and I will let you know how it goes. To those having problems I wish you luck and all I can say is keep trying. We seemed to have had a good out come. Thank You BOA For listening and beleiving the truth in this case.

A good face to face talk would be a good try also. She is coming back to Maryland next weekend. She will need me to go with her. My daughter is so upset, scared, humiliated, embarresed and feels just plain old dumb. She has never been a child to lie or be told she has done something wrong without breaking out in tears. I can't tell you all how good of a kid she really is. She is just so hurt by all of this. She would give anyone at BOA her shirt off of her back even the ones who have dona all of this to her. I know you all here don'y know us from a whole in the wall but all we have told is the God's honest truth. It is such a shame for this to have happened to her. Thanks for the advice next friday BOA here in Maryland will get a visit. Thank all of you for the help.

Hello: I know you said you worked hard writing letters to the bank, etc. I have helped many people with problems of this type. There is nothing like going to the bank and setting down and talking face to face with the branch manager or a person who can help you. You will get more from a meeting like this than you normal will from a letter. You have to make a personal appeal to them. I have never found any one out to just ruin a young persons record with out a reason. You have to prove this to them and hope they will be fair. Most people in this business can spot a fraud right away. good luck.

No she did not spend the money she maintained a positive balance the whole time. We worked hard today sending letter to BOA and Chexsystems in hopes of getting this straight. We also called her bank here in Maryland that she has used for many years. They gave us a letter stating she was always in good standings with the bank and they are very willing to help her as much as they can. They to are very concerned for her, they know her. BOA never got the chance to see that she is a good consumer who just made a mistake not fraud. We can only hope that the bank and Chexsystems can be understanding. We have consulted with a Lawyer for advice and hope we don't have to go that route. I just wish that BOA would have had trust in her word. Boy I sure miss the good old days when there was trust in people. I do understand that BOA had no clue who she was but they should have investigated a little before booting two good people out of thier bank. We will just wait and see what happens in the weeks to come. But I like you feel there was no fraud because she did have a positive balance. It was all of her birthday checks that she got that she was depositing so for her it was just some nice extra money.

Depositing an empty envelope is not fraud unless you also try to withdraw real money before the bank notices. If she just let it sit, that is good evidence it was a mistake and she did not intend to defraud the bank. Why would the bank give back all $1003 if $428 of that was a phony deposit? No "form" needs to be filled out for an ATM deposit. These details make me suspect that the basic facts of the case haven't been accurately reported.

Thanks for advice... I do fully understand as a bank that did not know her to feel that way. But the customer realations should be a little eaiser-we would have givin them a second chance if they messed up. To me before they took such a harsh steps they could have had her get a letter from her local Maryland bank she has been with 7 years, checked her credit and look at her job history. Can we get checksystem to take these charges againts her off? Can we place a letter of explanation with them? She is not a crook and would never even try to be she is a good adult wo has always taken pride in all she does. But why would they cancel the room mate? He was with them for years. I have just never even heard of such a thing. I thank you for your reply and we are still going to talk with a laywer today to get advice and steps that we maybe able to try. She will never be a BOA customer again and I myself am a little glad that I stayed clear of them. We are all human and make mistakes including Banks and other big finance firms I have had problems with banks and credit card companies making mistakes but they were honest and we stayed with them. Because everyone and every computer system out there is not flawless. By what I have read BOA is not rated to well. The bank she was with prior does not even have one complaint anywhere on line. I will take your advice and Thank You.

Advise your daughter to write a letter to BofA's executive relations department explaining the situation. They may consider at least removing her name and her roommate's name from Chexsystems database. Although I wouldn't expect that they'll allow her to reopen the account at BofA. If they won't change the record, there are banks that will open accounts without checking Chexsystems. Do a google search for non-chexsystems banks and I'm sure you'll come up with a few. You have to understand that although it does sound like your daughter made an honest mistake, ATM deposit fraud is a real problem in the banking world, and the chain of events is what one typically sees in this type of fraud. The fact that she had just opened her account 2 months prior and then made an empty envelope deposit looks like she's part of a fraud ring from the bank's perspective. The bank is only taking the normal steps it would take to protect itself from loss, and advising a checking account reporting agency of the activity so that other banks aren't exposed to loss either. I wouldn't say this is a ripoff, moreso that the bank is acting as it should based off of what has happened.
