A few months ago, I had purchased a domain online and was accidentely charged twice for it. The domain costs $12 each and I had $22 in the bank. Because of the second charge, my account was now overdrawn. Not Bank of America's fault, ok. So I put in $30 into my account, to cover the standard $25 overdraft fee and the money that was overdrawn. It SHOULD have been plenty.

I come to find a few days later that my account was overdrawn $166.35. When I looked at the online banking, I saw that on September 25th, I was charged TWO overdraft fees and that was the cause of the second overdraft. How Bank of America works is every day your account is overdrawn, they take an additional $25 from your bank account. So a week had gone by and now it was -$166.35 instead of what it should have been, around $3.00.

I then receive a letter from Bank of America telling me to simply deposit the money into my account and everything would be OKAY. Well I refuse to pay that at all. (In fact, THEY owe ME money because there WAS money in my account.) I read further into the letter, and it says refusal to pay the ammount will cause my account to close and make it harder for me to be able to get another account.

So after I read the letter, I decided to call them. After waiting on hold for what seemed like forever, I finally spoke to a representative and told her my story. She said as far as she knew, that my balance had to be paid, no exceptions. I asked to speak with a supervisior, which I did, who said the same exact thing. So I told her to put on her little computer that I refuse to pay it and any calls to my home will not be answered. I get a bank statement a few days later saying my account had been closed. Okay.

Now yesterday, I get a letter from NCO Financial Systems Inc saying that further action will be taken.

My advise is to stay away from Bank of America. Obviously, I'm not the only one with these problems. There are plenty of stories on here that will prove so indeed. In fact, my mother just switched banks due to Bank of America's service, or the lack of.

I plan on fighting this 'debt' for a while until it is settled. I am not to blame for this 'debt' and Bank of America is.

I like many have the same situation that won't go away. Bank of America will not get a dime more than is actually owed. To continue your fight you should direct your complaint to The Office of the Comptroller of the Currancy, 1301 McKinney Street, Suite 3710, houstan, Texas 77010 They are the primary regulator of National Banks, please pass this information along so we can get B of A to stop their fradulant activities.

Bank od American is one of the worst ones about letting debits go thru before your deposits. That way they can get ahold of the over draft money...because they did this i was over drawn by $200 and charges 5 YES 5 overdraft fees...My boyfriend called them and asked about this and that he had heard of thier unfair practices..they immediatly refunded 4 of the overage fees.. that was $120 right there!

Thank you. You have been very helpful. Yes I have the statement with the two overdraft charges which I had mistaken for the 25th which was actually on the 24th. And it also has my $35 DOLLAR deposit (I remembered it was AT LEAST $30) on that same day, the 24th. I plan on writing to NCO Financial Systems Inc this week to dispute the debt for the third time.

If what you are saying is true, there should be a clear record on your bank statement; which I pray you have saved. All the proof is in that statement, and it is crucial evidence, because they cannot denigh their own records. The timing of all transactions would be available in a standard bank statement. They are also not allowed to deprive you of the specific information, about your own account. It doesn't matter that the account is closed out. For the designated times you banked with them, you are entitled to those records. I would not pay it. Another source of evidence would be in your payment to cover that accidental double billing. On the day that you payed, they might have given you some kind of receipt, as proof of deposit. Just add that to your collection of evidence. Check your credit report. Make sure they have not reported you unfairly or inaccurately. If so, add that to the list of charges pressed against them. For example, if you had to pay a $9 or higher fee to get your report, let them pay. All communication with them from now on should be in writing. Send the letter to a specific individual in authority, and make them sign for that letter, stating you are not obligated to pay, and have proof. There are banks out there in the "litigation jungle" as the ED states, who the government has accused of using overdraft fees for profitmaking. This bank might be one of them, but I'm not sure. In addition, do not let too much time to go by on this one. Statute of Limitations are unknown. Whoever you purchased those domains online from should compensate you for their error. Really at the end of the day, you should owe ZERO dollars. Hope you get your refund. Merry Christmas Rip-off Report Volunteer
