I, too, was a "victim" of sorts of Berkeley Premium Nutraceuticals, Inc. I ordered their FREE 30 days trial of Avlimil and paid $4.50 in shipping and handling using my bank check card.

I read on the website for Avlimil (www.avlimil.com) that you could save money by ordering via their "Managed Care" program but I wanted to try the product for the 30 days first.

After about 25 days, I determined that I would like to continue trying this product because their web site clinical trial report said it could take 3-6 to ascertain any benefit from this product.

I went back onine and order a 2 month supply using my American Express card. Imagine my surprise when I was charged on BOTH my AM EX card and the bank card I used for the free sample order for this 2 month supply.

After placing a call to the company and talking to a VERY rude MAN (this is a woman's product)it was determined that I had inadvertently opened two accounts. At NO point was the "Managed Care" program mentioned to me on the phone but I knew when placing the order for the 2 month supply that I was signing up for this. I was advised my bank account would be credited and that account closed and the AM EX account would remain open for future orders.

I read on the web site that you had to try this product for a full year in order to be able to take advantage of their full money back guarantee at the end of one year (minus shipping).

I just received another 2 month supply. For some reason, and I'm not complaining, the cost has continued to go down over this period of time. At first I was charged $104.50, then $150.00, this last order was $70.00 for the same time period of supply.

I am now reaching the point where my one year will be up on August 22, 2004. I noticed, in the recent package I received, with the most current 2 month supply, that there is a card that states their return policy which is different than that which appeared on their web site a year ago and which is still stated on their web site. Their web site states "... woman who try Avlimil for a year and are not completely satisfied are eligible to receive out 12 Month Satisfaction Guarantee." The card that came with my recent shipment states that "If after purchasing a full 12 months' supply, you aren't completely satisfied with the results, we'll give you a full money-back refund*" "*..... 12 Month Money-Back guarantee applies to all product purchased and billed after September 1, 2003."

Now, I started August 22, 2003. By my calendar, a year will be August 22, 2004, not September 1. If I wait until September 1 to request a full refund of all product purchased, I will end up getting more supply, more charges and not get my full refund back and I am picturing a vicious cycle trying to cancel this "Managed Care" deal AND get a full refund.

It took 6 months to get the credit to my bank card account when I had the first issue stated above. I can only imagine how long trying to get a full year's refund will take.

That is why I have labeled this post a preemptive strike. I am looking for information from anyone who has purchased this product for a year, failed to achieve ANY KIND OF RESULT WHATSOEVER and is also seeking or has been successful in getting their money back, in full. We're are talking $300-$400 worth's here - it's not peanuts.

This product DID NOT work for me after all this time. I have noticed no positive results whatsoever and I have taken it fatihfully for almost a year. Of course, I will continue to take it until at least August 22, 2004 so I do not void my chance of obtaining the refund promised by this company.

I expect a battle and would like to know if anyone else has embarked on the same battle or if anyone else has been successful.

Steve Warshak, sole owner of Berkley Nutraceuticals, has been found GUILTY of mail fraud, fraud, money laundering and other various things and is headed for jail, folks!! I finally got a partial refund from this lousy company but it was a hard, long fight. Now he has been found guilty of a number of things which finally vindicates every person who has been fleeced by this guy and his products and illegal business practices. What goes around, comes around, Steve-o - enjoy JAIL. Couldn't happen to a nice guy. Now, let's hear it from all the loyal Berkley employees who insist that there is nothing wrong going on there.

I finally got a partial refund from this lousy company but it was a hard, long fight. Now he has been found guilty of a number of things which finally vindicates every person who has been fleeced by this guy and his products and illegal business practices. This is an update to my posting of July 2004. After doing what I felt was 100% compliance in order to qualify for their refund, I called Berkeley Neutraceuticals to get my money back for the 12 months worth of Avlimil I purchased from this company. Surprise, surprise, like the hundreds of others here, I did not "qualify" for the refund. Despite James at Berkeley telling me in July that I would indeed qualify after purchasing two more 30 day supplys of Avlimil, which I did and was charged $70.00 for. I talked to 4 different people and was given 4 different excuses as to why I did not qualify for a refund. Every time I began to read my notes from various conversations with employees of this company including dates and times and in some cases, recorded conversations, they would get mad and transfer me to another person who would then do the same thing. I kept volumes of information as I purchased product including web site page printouts, all packing and shipping materials and all empty products packets. They did not care. No matter what I said, they disputed it and told me I was wrong and did not qualify for a refund. Their refund policy changes almost daily so it is almost impossible for ANYONE to qualify to get their money back. Their web site changes almost daily, all TWELVE of them and their phone numbers (too numerous to even list) change all the time too. This company is adapt at screwing the consumer. The BBB in Cincinnati, Ohio where this company is headquartered has processed over 7000 complaints against this company in the last 36 months. Like many others I learned too late that the only goal of this company is to sell bogus products and steal your money. I have filed a complaint with the Cincinnati, OH BBB and the Attorney General of Ohio and Michigan. This company needs to be held accountable for its deceptive products and its extremely deceptive business practices. BUYER BEWARE. No matter what their refund policy states today, it will change to tomorrow and NO ONE who makes the mistake of purchasing their products will ever quality for a full refund as they advertise. The only thing what will stop this is a class action suit to force this company to honor its own written policies and then put them out of business.

After posting my report here, I called Berkeley Premium to prepare myself for canceling my "Managed Care" account and getting my full years refund. After two phone calls and a total wait time of about 25 minutes, I was told that the free 30 days supply ordered first DOES NOT count as one of the 12 months. I was advised that I needed to buy two more months supply at a cost of $70.00 which would be sent automatically on September 10, 2004. After that, I was advised that I needed to call the same number to cancel the "Managed Care" account and request my full years refund. Sounded fairly simple. Time will tell. All I can say now is buyer beware. I have done extensive reading on this site about this company and its questionable practices as well as its questionable claims of their products even working. Wish I had found Rip-Off Report prior to even buying any of this product from this company. I too figured that a company who could afford to advertise in such a large way was on the up and up especially considering that this product was also recommended by my own doctor. So, again, buyer beware.

Feel sorta stupid.. should have used my spellchecker... meant to type pre-emptive (not premptive) and the clinical trial report on this company's web site said it takes 3-6 months to see any results (not 3-6). Just wanted to clarify these items.
