I file a complaint against BNSF Railroad I sent to the EEOC. But the eeoc send my complaint to Several EEOC office. The BNSF Railroad wouldn't pay for me to have safety training. They say that they gave reasonable accommodation giving me more time and my Disability is I don't understand what I read. I need someone read the test to me. But I file complaints to the EEOC and have it for over 7 to 8 years!

If the EEOC has had your case for 7-8 years, then you have no case.  You may believe you have a case.  But what you think doesn't matter.  The attorneys at the EEOC have decided you do not.  It has nothing to do with whether we or I are judging you personally. 

There is nothing personal here.  The fact is there is no agency on a Federal or State level that would take 7-8 years to figure out whether you have a cause for action against BNSF.  The most it would take would be one year.  If you don't know after one year what's going on, then the EEOC isn't going to act.

You can possibly contact a private employment attorney that can take the case - just make sure the attorney doesn't rip you off because they can take a case just to cover fees.  However, if it has been 7-8 years as you say, then the attorney may say it's too late to bring an action against BNSF.

The 7 to 8 years is how long the EEOC had my complaint! I do understand that safety is important and I know that! But you don't understand what i saying!  Thank you Bryan Brazeal

....my Disability is I don't understand what I read.  Comprehending what you read is understandably a problem and the ADA does require employers to make reasonable accomodation to you.  However, if it has been 7-8 years, as you claim, then that would be more than a reasonable effort to accomodate you.  If you are still unable to pass the test, then the EEOC will look at the 7-8 years you've attempted to pass, and see the employer has made a reasonable effort and dismiss your complaint.

Safety is important for all railroads and people get killed working on the rail lines.  Passing a safety test is vital for anyone working for a railroad.  Perhaps another line of work would be beneficial?
