Make sure that every communication you have is in writing.  Do not accept any date or time estimations given by a rep over the phone. Understand that you are working with a transportation broker, not a transport company.  Understand that their contract does not guarantee a transport time.  It gives BoatsExpress 30 days to locate a transport company.  Understand that any special arrangements are not an option.  Understand that if you do agree to the contract terms, you are not provided with the information of the actual transport company.  Please make sure you have read and understand the contract in full.  There are terms in the contract that Boats Express will interpret differently then you.  (convenience rate, dispatch, etc... )  Expect all assistance to potentially end the moment you wire the deposit money.  If you attempt to inquire about the date or transport company, you will be reminded that Boats Express has 30 days to locate and dispatch a transport company.  Understand that if you attempt to cancel the service within the 30 days, Boats Express WILL advise you that they have already "dispatched" a transport company, and your deposit is no longer refundable, once a transport company is dispatched.  While Boats Express advises that credit cards can be accepted, please understand that ultimately the money is accepted via wire or money order, as this removes a consumer's entitlement to dispute the transaction with their card services when Boats Express does not meet its contract obligation.   Please accept these statements as objective in nature.  





My personal subjective experience.  I enlisted BoatsExpress to move a 38' Sea Ray that i was purchasing from a Marina.  Bob Graviss Jr was the salesman i communicated with.  I ultimately signed the contract and wired the deposit monies.  After not hearing from Boats Express, or a transport company for a few days after confirming receipt of the money wire, i inquired with Boats Express about the status of my order.  I was advised that they have 30 days to meet their obligation.  It is now 60 days  since i have signed that contract.  Neither the marina, nor I have been contacted by a transport company.  I have since inquired multiple times upon the expiration of the 30 day contract.  I have yet to receive any form of response.  Boats Express representatives that were involved in my experience are:  Bob Graviss Jr.([email protected]) and Greg Hutchens ([email protected])

The BoatsExpress rep actually sent me 3 different contracts. I signed and agreed to the contract with the accurate pricing. I terminated the contract prior to dispatch because of the 10:09 phone conversation that took place at 1:54p on 4/23, where the BoatsExpress representative ridiculed me in my inexperience, denied the details of previous conversations, and told me, in regard to his quoted delivery time, words and emails dont matter because he 30 days in the signed contract. The details of my schedule and our arrangements were discussed during the 21 email communications and 5 phone communications that took place prior to the time i signed the price agreement. Note that none of those are referenced in the business response.  

 The case is also currently listed with the West Florida BBB, via case# 67173945  There were many more email communications that took place that are not included in the Business response that BBB received. Most notably is an email communication from me, sent on 4/20/2010, Where I stated that "have some questions first in regard to your side of the commitment." It is now understandable why the representative was insistamt on discussing these details over the phone. I have the details of each phone conversation, as well as all email records if they are requested. The BoatsExpress representative included only a portion of the words of my termination email in his response here.  I actually composed the email very kindly, and did not point out the details of the phone conversation that took place a short time earlier. It was my effort to terminate things on a cordial level, and not communicate that i was still very angry and personally offended.  It was not to point out the significant contradiction between the representative's statements and statements made by Greg Hutchins, the company President, whom i spoke to while trying to track the representative down for over 2 days. All of these are supported in email and phone records. 

The representative did send me an email diagram of my vessel model. For that, i could justify a $25.00 fee. Beyond that, no work was performed. No company was dispatched. I waited to be contacted by a transport company, as was communicated by the representative. No company contacted me or the marinas for over 30 days.. Even if the representative wants to change the definition of "convenience rate" in their contract after the fact, what does it prove? Please prove where the work that i paid money towards was done.
  Addressing anything other than this would be nothing more than an effort of misdirection by the business.  My personal records are far too meticulous to take such an attempt lightly.

The Quote was sent to Mr. De Vries and he signed the Contract on the same day April 20. ( see attached Contract ). On April 23rd Mr. De Vries advises me that they have made other arrangements to transport the boat. By Mr. DeVries own words he just decided to have another transport company just a few miles away take the boat. He was not satisfied that a truck had been dispatched to pick up the boat the following week. On April 30th I responded that based on the Contract Mr. De Vries signed that his request for a refund has been denied based on the facts that a truck had been dispatched, as stated in paragraph 4 and our Contract that you signed says it is good for 30 days, as stated in paragraph 5.

Here is the email Mr. DeVries sent me on April 23:

Bob, I communicated the information you gave me to the seller. The seller cannot incur any more costs and together, we could not get the commitment we needed from that marina to perform the work necessary. Therefore the seller tracked down a hauling company and put them in touch with me. The boat will be placed in the water instead and moved to the haulers marina a few miles away. The hauler will then transport later in the week. It wasnt that I needed the vessel in Spring Lake immediately, as much as it was that the seller needed to wipe his hands of her. This is also a way to make sure that the topics of loading and unloading are also taken care of.
