I am filing this complaint against a car dealer with whom I completed a transaction via eBay, yet did not receive the car in the condition as advertised on their site. I believe this is an internal eBay issue, because the Seller (brauliocotero14) is going outside of their payment policy to collect money directly from the Buyers and they are allowing him to continue posting car sales on their site.

This is what happened: The Seller posted a "completely restored" 1968 Mustang for sale for $21,500. The ad described a beautiful car, what had been done to restore it, what items were brand new, beautiful pictures, and a video of the car being driven. I spoke with the Seller (or his representative, Eddie) directly on two occasions and he assured me there was nothing wrong with the vehicle, it was beautiful as described, ran perfectly, road ready.

When I purchased the car via "Buy It Now", the seller sent me an email asking that I call his number and he provided me wiring instructions. (I get mixed messages from eBay because they told me they do not send an invoice for cars, only the deposit, and yet the Sellers are not allowed to conduct any transaction outside of eBay (which he did).

The business name is AJ Auto Sales, Inc. Yet I've not been able to find a location for them online. I did not pay via an eBay invoice. I wired the money to the Seller and asked for the car to be shipped to me. When I received the car it was not operable or in the condition as declared by the Seller; a rat had eaten huge holes in the interior, the clutch and steering did not work well enough to safely drive, and after driving it 3 miles I barely made it home.

Then the oil drained out in my driveway due to a rear seal leak. The battery died the next day and upon removal, the entire engine compartment hidden underneath was completely rusted out leaving a 12" hole, where the battery literally could have fallen out of the car. All this within 2 days of receiving the car and without a professional mechanic to determine what else may be wrong with it. 

Then I received an email from eBay stating the Seller opened a case for Non-Payment. I emailed the seller asking him to close the case because the car was paid. After I discovered that the car was no where near the condition the Seller promised, I called eBay to complain and was informed that it was my burden because I didn't inspect the car personally or hire someone to do it for me as I live 750 miles from the dealer.

So I needed to contact the Seller to try to work out a resolution. I sent the Seller two emails, one with my complaint, asking for $4,000 repair reimbursements to bring the car up to his description, and one to again ask that he cancel the Non-Payment case. The Seller did not respond to me. Rather, what he does is open Non-Payment cases and let them expire within eBay's timeframe to respond, so the Ebay "system" thinks the car is unpaid, and then he appeals to the Seller Feedback dept. to have negative feedback removed because the transaction wasn't completed.

I have since discovered that eBay Sellers can pay EBay to remove negative feedback. This is my major complaint with eBay and the reason I'm reporting him to you as a fraudulent Seller. The Dealer has worked their system so that Buyers he cheats cannot leave negative feedback warning other potential buyers of his scam.

Unfortunately eBay's Buyer Protection does not cover mechanical discrepancies with used cars and I didn't have the car inspected so I have no claim. Bottom line, my complaint is that a Seller/Dealer is advertising cars as completely restored, potentially lying to people and deceiving them with old pictures and video as he did me, and providing defective vehicles, leaving them with no recourse with eBay to even provide negative feedback which is intended to warn future buyers.

His feedback is 100% and I cannot be the only person who's been scammed by this man. I paid $21,500 + shipping for a car that I have to have towed for repairs, while the Seller/Dealer continues to run advertisements just like mine for restored cars on eBay.

The eBay Security Team say they are investigating this Seller, but have not indicated I will be involved going forward. Since he can pay to have negative feedback removed, I doubt he will incur any sanctions from eBay.  BUYER BEWARE, DO NOT BUY A CAR FROM THIS MAN OR HIS REPRESENTATIVES AT AJ AUTO SALES, INC.

Perhaps you need a dictionary. Complicit is defined as an associate or accomplice in wrongdoing.

You failed to provide a link to an eBay web page that supports your claim that motor vehicle sales are exempt from eBay’s policy that prohibit payment transactions from being completed outside of eBay. You evaded that request just as you evaded the request to provide a credible/reliable link that supports your claim that sellers can pay eBay to remove negative feedback.

Now your entire story is questionable. Enjoy your Mustang.

eBay payment policies state:

Offers to buy and sell outside of eBay policy

To make sure buyers and sellers are fully protected, transactions that started on eBay cannot be completed off our site.

Please provide a link to an eBay web page that supports your claim that motor vehicle sales are exempt from eBay’s policy that prohibit payment transactions from being completed outside of eBay.

Your failure to follow eBay policy makes you complicit in your loss.

You Sir, sound like an eBay Seller.  Do your own research or move on.  I only know what happened to me and my personal conversations (multiple) with eBay Motors and eBay Security and Safety.  Me being "complicit" in my getting ripped off is your way of attempting to place all of the blame on me.  I said I should have had the car inspected, but even the link to have an inspector review the car doesn't include any more than a cursery "look" at the car, mechanical issues are not inspected, so other than a personal test drive, a review would not have found the issues I reported. 

My complaint is about false advertisement, purposefully deceitful discussion with the seller's representative, and underhanded way he cancelled the transaction after I sent him $21,500 and already had the car in order to remove my feedback and ultimately the entire transaction in MyEbay. 

THOSE ARE MY FACTS.  I don't have to prove anything to report on this site a deplorable Seller that eBay obviously supports.

eBay favors the Sellers as that's where they make their money!  Just by doing a little research you'll find numerous articles, posts and blogs from people who have experienced getting ripped off using eBay.  Here's one example of a lady's story and her efforts at exposing eBay Motors for their Seller bias.  Many links and information on eBay's policies here:  https://archive.docsqualitycars.com/feedbackremoval.htm

If you read eBay's own Seller Support Page https://www.ebay.com/help/policies/selling-policies/seller-performance-policy/seller-performance-defect-removal-policy?id=4352, they state they will remove feedback based on certain conditions.  These conditions are exploited by the Sellers to ensure they can maintain 100% even when they bilk the buyers, as in my case.. 

The Seller of my car not only removed by negative feedback, but as of today 9/24/19, the entire transaction has been removed from MyEbay!  I spend $21,500 for a car on eBay and now can't even see the transaction 2 weeks later.  I paid for a car, have possession of the car, and my transaction is gone! EBay has allowed this!  HOW IS THAT FAIR? 

He's done this because he had a You Tube Video of my car and guess what?  ANYONE can comment on a You Tube video, so I did.  On mine and every other video he's posted of cars for sale.  They are now gone.  I will not relent and continue to file complaints with every agency I can so that he has a "mark" and hopefully will be investigated for defrauding people.

I admit I should have had my vehicle inspected.  That is not in dispute.  What is allowed is a listing that states "Follow Seller's Payment Instructions" as mine did.  While I received an invoice it was just for the deposit, and in that email the Seller said "Call this number" and provided wireing instructions.  This is NOT against eBay's policy for Motor Vehicles!!  Rather, this is how most people arrange payment.  This Seller's contained fraudulent information in the description, pictures, and video.  eBay knows it and they allow it.  

My post is to share MY story and warn others about eBay's unfair bias towards Buyers who spend thousands of dollars on vehicles.  Pointing fingers at me is frankly, pointless...

You were cheated because you violated eBay policy by completing the transaction outside of eBay and agreed to purchase a vehicle sight unseen without an inspection or test-drive.

Please provide a credible/reliable link that supports your claim that sellers can pay eBay to remove negative feedback.
