I'm still trying to figure out what you think the ripoff is. This is Ripoff Report, after all. From your follow up, I gather that you think Capitol One should have given you a break because of your circumstances or the amount that you owed. I can assure you that EVERYONE who has to default on a credit obligation has reasons. There is nothing special about your case. You may quibble about how exactly the creditor goes about collecting the debt, but as long as they do it legally, that's not really your call. The bottom line is that creditors have a right to go after anyone who defaults via the court system. It doesn't matter if you're a big fish or a small fish. By the way, next time there's someone in your backyard peering in your childs window, call 911 and have them arrested.

I know I defaulted never claimed I did not know this. I am saying I think Capital One should find bigger fish to fry than a $200 debt. And the crazy thing, even though they got this judgement I still had no way to pay it. So 3 months later I get a pay off offer, for 50% of the debt. I called and haggled it down to $600. So all this insanity, court time, collections, process servers. the grand total..$400 more than they started out with. There was no winner here. How much money did Capital One pay out to get this extra $400? I just think they could have turned this over to collections, put it on my report and wait for me to pay it. I dont think calling everyone in WI with my same last name, hundreds of calls, and some crazy guy out in my backyard at night peeking in my childs window, taking pictures of my yard, court dates, was a bit extreme. I could see a debt of 1,000 or more but $200? And yes you can post back that I am a loser, dead beat, stupid, and on and on. I once judged people like me, and then it happened to me. I was disabled with OCD, I have 4 girls and had been married for 18 years. I had always paid our bills, and maintained our money fine. Then my husband got hurt at work seriously,the end result was cronic untreatable pain it spiraled down to severe depression suicide attempts and complete hell. We had 4 children and 2 parents that couldnt make ends meet. I DECIDED to use credit cards to try and get needs for the children, and I defaulted. I was on the verge of homelessness. What choice would you make pay Capital One endless money, due to late charges, fees, etc.. or buy clothes and food for the kids? I spent the little bit of money I had at the time on the most importance at that moment. $200-$300 at that time was a lot of money to me. My point to all this rambling is good people make mistakes and I do not think Capital One has to prey on people in poverty they can make a living somewhere else. Why give these credit lines to people who have no job or very little resources? They were clueless that this person would default? These title loan places, blue hippo, JD Byrider, they make their living off the backs of people with no resources. And your next comment will be I am a bottom feeder because I am disabled, I have went back to school, finished used my Associates degree to gain a good job, my x also worked hard in physical therapy and is now working full time again. And we are re-paying all are debts and cleaning up the credit mess.

It only rebuilds your credit if you pay on time and do not default. Everything else that followed is what happens in the normal course of a collection. Including the much larger amount of the judgement in court. You see, not only were you pestered by collectors, process servers and courts, you were also paying them for the privilege. Just out of curiosity, what did you expect to happen when you defaulted on this debt?
