A John Denton called me regarding a network marketing training program. He indicated the cost was $10,000. I indicated I did not have that kind of money. He disputed this indicating that I must have a savings account or other money/accounts of some sort to draw from. To prove it, I (stupidly) relayed my credit card number after he asked about how much credit I had available. He was very coercive so I wanted him to realize that I only had a couple of thousand dollars worth of credit available. He ran a check but also in the process charged my card to the full extent of my existing credit in the amount of $2,000. I protested stating that I had auto payments that would be coming through that would result in over limit fees. (After getting off the phone with John Denton, Capital One telephoned me to advise that he had attempted to charge an additional $500 to my credit card subsequent to our conversation without my knowledge.) John Denton told me not to worry because Id have a $5,000 check by the end of the week that would more than cover the charge and that they would assist me to accomplish this immediately. Then he said that I should leverage earnings to meet the $10,000 fee to become an inner circle member. He promised an all-expense paid training session in Malibu, CA or hed fly to my home in Minnesota to do the training. I never heard from him again. The reality of the situation was that they basically blew me off from the beginning. Their initial scheduled phone conference with an agent was totally ignored and I finally had to call them. The agent seemed surprised and unprepared to speak with me. This was their repeated pattern which reflected a total lack of attention to any service or training commitments. It is not about network marketing training, it is purely a money-grabbing scheme which is unlawful. The Los Angeles Police Department is actively investigating them which will result in charges against them. Needless to say, despite my numerous timely attempts to have the $2,000 charged back to IncFortune.com, which included providing Capital One with various forms of documentation, Capital One has sided with the IncFortune.com predators and refused to credit my account. Therefore, I consider them complicit with and an accomplice to this internet marketing scam that has fleeced at least 80 to date including the elderly who literally turned over their last dime to these no good gutter snipes which has left them literally penniless. This is an admonition to beware of the Push Traffic, a/k/a Success Rate, a/k/a IncFortune, a/k/a Jump Launch, etc. scam AND Capital One. Dont do business with ANY of these people. They obviously are looking out for each other and NOT for the good of the consumer.

I am the aggrieved victim in this whole debacle and am providing an update to the lawsuit and accompanying events involving Raygoza, et al, and Capital One. 

After Capital One refused to reconsider after providing them with information on the class action lawsuit against the scammers, I appealed to the Office of the Comptroller of the Currency for assistance.  They monitor federal banking institutions for violations, etc. 

When all was said and done, the OCC did nothing on my behalf and basically sided with Capital One.  Again, this is just another case where the consumer doesn't have a chance against banking institutions, and the governmental agencies just stand by ineptly and allow these injustices to take place.  Makes you wonder what your tax dollars are paying for.  I have yet to receive any assistance from any governmental agency, whether state, local or federal, in resolving any disputes with rip-off artists involving consumer fraud.  It's almost a waste of time to even appeal to them for help.  It just wastes everyone's time.  Eventually, usually after months of waiting for their response, they simply tell you they have no jurisdiction in these matters and that you should hire an attorney.  Oh really?  How disgusting. 

Anyway, the outcome of the lawsuit is that Raygoza, etc., defaulted but the federal judge issued a judgment against them for over $900,000.  They are obviously guilty of fraud and the evidence is overwhelming against them.  A copy of the judgment was subsequently sent to the OCC and to Capital One as well as to the Attorney General's Office of the State of Minnesota.  I seriously doubt if this will make any difference on my behalf with Capital One, and the OCC, no doubt, will continue to be ineffective on my behalf.  

I would like to share with you the letter I received from Capital One dated August 16, 2011 regarding their continuing decision not to reverse the credit card charges despite the federal class action lawsuit against Raygoza, et al.  Please feel free to write to this woman to express your opinions about the outcome at:  Denise H. (didn't provide her full name - what a weasel!),  Capital One Corporate Offices, PO Box 85870, Richmond, VA  23285-5870.

"We received your most recent follow-up letter that was dated June 16, 2011, and sent to the Office of the Comptroller of the Currency.  We regret that you sent previous correspondence, dated January 30, 2011, of which we were not advised.  We also regret that your continued dissatisfaction with our resolution to your dispute with the merchant INCFORTUNE.

Per your letter, you maintain that you will not send any additional payments to Capital One because the merchant fraudulently charged your account, and you believe that Capital One should be doing more to defend and protect its customers.  You also reference that you made final payment for the above-referenced account in August 2010; you believe our acceptance of this payment should cease any further collection regarding this incident.  

We do regret your continued dissatisfaction and frustration, but we respectfully continue to uphold our previous responses.  As we explained in our other correspondence, a review of your dispute confirms that it was handled in accordance with our usual and normal practices and procedures.  In addition, we show no settlement agreement was made regarding your account balance, and we consider the balance to be valid.

We regret this is one of the cases in which we are unable to assist our customers.  Please be advised that we may not respond to future similar correspondence received from you regarding this matter.  Please feel free to contact our office with any additional questions or concerns at

There you have it, folks!!!  Talk about a fundamental failure to act responsibly on behalf of their customers!!!  So, what's in your wallet?!!!  If it's a Capital One card, I would suggest ripping it up immediately before you are confronted with an issue involving fraud that Capital One refuses to act on and continues to demand payment for!!!  I have been harassed now by a law firm seeking payment and I believe they have been trying to serve collection papers on me.  My credit score has definitely dropped since this incident which has directly affected me in multiple ways.  Once again, DO NOT apply for a Capital One card and either quit using that card if you already have one or rip it up and cancel your account quickly!!!  I have been SO damaged by this whole fiasco.  It is truly unbelievable.

I am the aggrieved person who has been reporting on this continuing post.  I have been unduly victimized twice due to an internet scam; first by Incfortune.com and then by Capital One who refuses to do a chargeback.  The wheels are in motion and a large class action lawsuit in Federal District Court has been brought against the perpetrators, Incfortune.com, and their other phony businesses.  I am one of many plaintiffs claiming damages.  Even though I brought this litigation to the attention of Capital One and the allegations that the perpetrators deceived and misled people, with many very horrendous stories of the crooks raiding credit card accounts, wiping out elderly peoples' life savings, etc., Capital One still refuses to act on my behalf and credit the charges incurred as a result of deception and sleezy practices.  Capital One, in my mind, is no better than the corrupt individuals responsible for these crimes and should be held accountable.  If you have a Capital One account, I would suggest cutting up the card and throwing it away.  You DO NOT want to be victimized whether it's simply a matter of inaccurate charges on your account or through out and out criminal activity and then have Capital One refuse to act properly on your behalf and demand you pay the money.  They have already begun harassing me with phone calls, and their irresponsible actions will affect my credit as well.  Their behavior in this whole matter has been appalling.  I will update as events unfold.

Here's the name of another crook that's part of the IncFortune, Inc. scam.  Please feel free to call/write/visit/harass on my behalf.  He claims he's a "paralegal."  What a joke!!!  If he's a paralegal, then I'm a brain surgeon!  Huh!  Hope he winds up on a chain gang with the rest of the good-for-nothing crooked scamsters!  Who does he think he's kidding!  What, when the police come for this guy after he and his cronies have been charging up peoples' credit cards unbeknownst to them he's going to somehow legitimize their illegal activity?  What a moron!!! 

Anyway, I could go on all day...

Please make your voices heard in a LOUD outcry against the crimes being commited by John Raygoza and his gang of thieves against no less than a minimum of 80 individuals who have been unlawfully preyed upon, many elderly, whose life savings were literally confiscated while the crooks laughed and mocked their victims, which has been documented and reported by at least one defector from IncFortune, Inc., or whatever company name they are using at the moment to allow them to proceed with their dirty deeds.

And yes you are correct that anyone can be scammed and I am also not going to say that I have never done anything stupid in my life because I have but I have been lucky in that I have never lost money like what happened to you.

You seem to have a legit claim however you are correct that most of the other reports here are not. The others typically happen because the person that lost money did not read the fine print. You also admitted that you were stupid in giving him your credit card and I applaud that. I understand high pressure sales.

I wish you luck in getting your money back and I will not deal with Capital One or John Denton and his company.

I could not see in any of the other posts where they said you were not Ripped Off.  Their points(which are valid points) is that Capital One has nothing to do with this.

Because remember this:

You gave up your credit card because you felt you had to "prove" something to some salesperson on the phone giving you a Sales Pitch.

They charged an amount on your card, and then attempted to charge another $500.  Yet after they did this and Capital One contacted you, you STILL made arrangements to get on some conference call.  Which would have it appear you still wanted to be part of this program.  So exactly what is Capital One(or any credit card) supposed to think?

Credit Card companies rarely get involved in what they consider "Contract" or "Quality of Service" issues, and that is basically what this comes down to.  It would be just like you having a remodel done on your house.  Say you pay them and you find that the work is not up to your standards or what they agreed to.  If you attempt to dispute the charge they will not approve it because it is a quality issue, instead they will suggest that you take it up in Civil Court.  So if you really do feel that Capital One is responsible then take the next step and file suit against them.  If you do this please update this report with the results.

My experience has left me with a broad distrust of people in general

Please take this as the advise it is ment to be.  Perhaps that is a good thing in your case.  Because the way you wrote the report you were way too trusting.  After all you just handed over your credit card information because a person on the phone was "coercive".  I really would hate to see what you would have given him if he was face to face with you.  If you don't recover your money, this will be a very expensive lesson.  But this will probably make you think and may save you from an even bigger mistake at a later time.

Pardon me, but the name that appeared next to Author was "Susan" in Houston.  Actually there were two sets of identities mentioned so maybe this was a collaborative effort.  I apologize for sounding bitter, but I AM!!!  My experience has left me with a broad distrust of people in general.  When I am grilled by individuals such as you, it makes me wonder why they would be so intent on gaining information unless they were somehow involved with one of the parties.  I really don't need to defend my story to anyone.  This was an obvious fraud and is being actively investigated by the authorities.  I am only one of at least 80 individuals who were taken for a ride.  There are a lot more interesting stories out there than mine to track and comment on, believe me.  Bravo to you if you've never been "ripped off."  There are millions of victims who did not set out to intentionally be hit upon but were  innocently caught up in a web of deceit by unscrupulous people, many of them top-level executives and elite professionals, I might add. As an  example, some of Bernie Madoff's victims were the most sophisticated of investors and the most unlikely individuals to have fallen for such a horrific, devastating scam.  They trusted him, however, and he obviously betrayed them in the cruelest, most heartless manner.  So, you really don't always know who is worthy of your trust and who isn't.  You may not have fallen prey to fraud yet, but you don't always know people as well as you think you might either.  Just a warning...

I really don't believe that you're not affiliated with Capital One in some way.  You're much too obsessive about this whole matter...and, I really don't believe that you have a life or you'd move on with it.

Ths is my LAST response to your silly questions because unlike you, I do have a life.  I have alerted all of the authorities about my situation and your inquiries are irrelevant, trivial and inconsequential.  In short, you're wasting my time. 

I did dispute the $2,000 charge.  Capital One has vascillated back and forth on this since last September when the charge was initially placed and disputed.  They would repeatedly credit my account and then re-charge it, again and again.  They can't get their act together now nor have they ever.  It's been an absolute nightmare dealing with their Customer Service and Dispute Departments.  The right hand doesn't know what the left hand is doing and they are essentially dysfunctional and totally incompetent. 

Now Ms. Little Bo Peep, go find your sheep...

I do not work for Capital One(CO) nor do I have one of their credit cards.

This all boils down to you giving your credit card number to John Denton, when you spoke to CO the first time why didn't you dispute the charge? Remember many people try to get something for nothing by charging something then disputing it and it ends up with the bank or the merchant being burned. I am not saying you did this but there are two sides to every story.

I don't know who you are, but I strongly suspect you are "in bed" with Capital One.  You're like a dog with a bone.  You are probably employed by Capital One and are being compensated in some manner by them to monitor complaints.  You are very annoying.   

Yes, I did advise that my money was coercively charged to my account and that the crooks tried to charge my account an additional $500 which I had no knowledge of and which was totally unauthorized, which is their method of operation - raiding peoples' accounts and charging up amounts which the victims then have to attempt to get charged back by their credit card companies.

By the way, get a life....

I think a course in reading comprehension would be good for you.  You're obviously not getting the story straight and trying to play the devil's advocate because you get some kind of kick out of it.  I shouldn't even respond as I get tired of repeating myself.  I was charged $2,000 by these crooks who initially wanted to charge me $10,000.  If I had had that amount of credit on my charge account, that is the amount they would have charged up my card for.  I did not give them any personal information outside of my credit card number.  Please go back and read the story and become informed as to how these crooks work.  

As an added note to the general public, Capital One has again refused to charge back this amount.  I received a letter from Denise Hailey at their corporate office, Capital One, PO Box 85870, Richmond, VA  23285-5870 indicating that they are sticking to their position.  I don't really believe she even has taken the time to fully examine all of the documentation I have forwarded to them.  They continually pass off this matter to another representative to issue a denial letter.  Say, here's an intriguing concept for the professional agitator, why don't you direct your attention and writing efforts towards her and address the greed and unethical and immoral position of Capital One rather than harassing me?  They will only acknowledge that I was "dissatisfied" with the service I received from IncFortune.com and indicate they are sticking to their position even though they are perpetuating internet crime by siding with this type of activity and outright encouraging it when criminals know they can now get away with it.  I propose that "dissatisfaction" with a product and the failure to deliver a service should be grounds enough for most credible credit card companies to do a chargeback.  The offer was never about an internet marketing course.  It was all a crooked money grab by deceitful, despicable scumbags who deserve to be in jail, which is my hope and the hope of about 80+ others who fell into their trap.  A criminal investigation is being conducted against IncFortune.com. Capital One is also being investigated by a federal agency.  For those of you truly interested in how these criminals operate in order to be vigilant yourselves, please visit the latest blog online by another victim and view all of the heartbreaking stories.  Go to:  http://onlinelowblowsandsuckerpunches.wordpress.com

You gave this guy account numbers and thought paying $10,000 for a job was a good idea.  I assume you also gave him your social security number, driver license number, date of birth and in a friendly conversation he got you to talk about where you were born.

What you should do right now is check ftc.gov click and click on identity theft.

In response to the Consumer Comment:  The attempt to charge an additional $500 to my credit card occurred after I hung up the phone with John Denton and was totally unauthorized.  I was completely unaware that he would attempt to do such a thing and was totally appalled by the sheer audacity of it.  This is their method of operation, however.  If you go to www.pushtrafficscam.com, you will read how they have charged up peoples' cards and maxed them out oftentimes totally without their knowledge.  In addition, these men are smooth operators and egg you on.  They say something like, "Come on, let's see how much credit you have on your card," and before you know it, they have charged your card to the max.

I am curious, when Capital One called you the first time and said he tried to take out an addtional $500. over the first $2000. Did you Authorize it? 

If so what do you expect any bank to do?  By authorizing the $500 you also authorized the previous $2000.
