I am being decieved, manipulated, defrauded (if there is such a word)lied to plus charged a fee that is not justified or is not past due. I have done everything right and everything that was asked, yet my home is being wrongfully foreclosed, April 17, 2007 (I was told this 2/15/07 by Countrywide rep over the telephone). My "case" is somewhat confusing. In 2004, I did NOT have a choice who service my mortgage, mine came from a "pool" to be sold. This is trickery, adjustable mortgage rates, and then told to wait 2-yrs to refi. I have NOT put myself in this situation, I pay monthly, no missed payments (I have documentation). I do not have unneeded things, I make (made) my payments, and live paycheck to paycheck. I am NOT a deadbeat borrower. I am a single-mother, American-born, hardworking, law abidding citizen, who supports her family to whatever extreme.

This unethical behavior:

FIRST encounter:

Started January 27, 2007 @11:40am - Jeremy from Countrywide. I called 1/27/07 checking my account if payment had went through (early this month, I signed up for bi-weekly transaction from their website) however, when I called on 1/27/07 and spoke with Jeremy, the first words he uttered, "do you want to keep your house", Of course, I do, why, this is foreclosure department. I could not believe what I was hearing, I asked again, WHY, he proceeded to inform me that I have 72 hours to call back, I would have a reinstate fee but could not give an amount. I stated to him, take my payment over the telephone. Jeromy, then stated to me that I cannot make December 2006 payment. This converstation was very minimal, Jeromy could not give any additional information, only that I would need 1,600.00 and have 72 hours to call back for payoff. Before any of the above took place, I could logon to my Countrywide web account, yet NOW I try to logon to their website, only to find out that I cannot. The website is temporarily down to try later. Well, I have waited and still cannot log on to my account.

SECOND encounter:

January 29, 2007 - Andrea-Countrywide - Ft.Worth, TX - Foreclosure, I repeated in asking WHY! I missed 2-payments October 2006,November 2006 and December 2006. I furiously stated to Andrea that I have NOT missed any of those payments and I was trying to make December's payment. Andrea (very kind, naive)I asked again if I can make my payment over the phone. Andrea declined stating no house payment can be made until ALL is paid. Again, I questioned her about what is ALL to paid, that I have made ALL my payments and am trying to make December's 2006. She would not accept my payment. She then went on to state that in February 2007 my rates will be 11.125% (I could not believe this)and to save all monies that I can, do I have friends that could help, go to church and see if they can help, family, will I get a tax refund, and to save up. I could apply for loan modification or a workout plan, which usually takes 15 business days and put account number on every page on hardship letter, bank accounts, and pay check stubs, then fax/mail to them. After 3-weeks, Countrywide would give me a reinstatement amount. Also, after this I can sign up for bi-weekly set up which comes from account automatically. I relayed to Andrea, that I signed up in December 2006, evidently it did not take place. Again, she declined to accept payment.

A letter arrived at my house from an attorney office stating I owe 2,044.80 plus 17.04 daily interest.

THIRD encounter:

January 30, 2007 - Cecil - Countrywide - Foreclosure - Cecil began with I missed January 2006 payment and there is no December 2006 payment. I told Cecil that I have made all my payments and I was trying to make December's 2006 - Cecil declined to accept. Cecil proceeded with adding February payment, attorney fees are 950.00 that I have a reinstatement payment of 3,726.10. I asked what that was for, Cecil stated inspection fees, property taxes (NOTE:I pay my own property taxes, I have been since 1985) title fees, and collection activity fee's are daily until resolved. Cecil stated I need to have all papers to WORKOUT department with loan number on all documents. I asked Cecil to fax me my payment history to me and she did. I have NOT missed any payments.

My experiences and struggles are many, I am infuriated with this company.

I sent a check to Countrywide January 31, 2007 for December 2006 payment. I do NOT expect anyone to bend laws, but what they are doing to me is unlawful. They have financially and emotionally intimated me. I need honest attention that I deserve. I am victimized.

February 10, 2007 - Home

Letter - Countrywide Management Committee on what this means, and what I need to do. I may be eligible for a repayment plan, loan modification, short payoff, or full payoff.

February 15, 2007 - Work

Melissa - Countrywide - she stated she needs 1 or 2 payments out of 4. No amount was given and Melissa was asked. Melissa to apply all papers to Workout Department with account on every page.

February 15, 2007 - Home

Recieved in mail. Letter from Countrywide WITH MY CHECK STAPLED TO IT. My check was returned stating the amount enclosed does not reflect the total amount due to cure the default or the funds remitted representing reinstatment of your loan was not sent via certified funds.

WHY would a check be returned if earlier that same day was asked for 1 or 2 out of 4 payments of WHICH I am NOT behind on my payments.

February 16, 2007 - Work 1st telephone call

Tim - Countrywide - stating April 17, 2007 is my foreclosure date. I pleaded with him - what missed payment(s) do I have. Tim went through my history aloud - I listened very carefully - all payments there EXCEPT that I missed January 2005 payment, December 2006 and January 2007. I stated to him that's impossible, why would you call now for January 2005, I tried to pay December's 2006 and I am confused with January 2007 payment. Tim, then, stated a check was returned in the amount of @##.@#, I asked WHY, he stated once it goes into foreclosure, we cannot accept money. WHAT!!!!!!!!!!!!!!!!!!!!!

I have these conflicting NONPAYMENT histories and they have placed my house in foreclosure that I have owned since 1985 no problems until 2004 with Countrywide. 30-years here, single-mother, struggled, continues to struggle, hard-working and Americans CAN DO this and keep homelessness DOWN. They actually believe they have done nothing wrong. I am entitled to my rights to defend a wrongful action against me. My complaint is not NOT "unjustified". I have not ignored Countrywide, I value my home TOO MUCH. No answers were/are given to me. I am NOT IRRESPONSIBLE. I pay my house payments first, I am not negligent. I am being defrauded out of my home that I haved had since 1985 at no fault of mine own.

Tim-Countrywide proceeded to let me know that the Workout paperwork has not been recieved to fax ASAP and make sure account number is on all pages sent to workout department. Tim asked me if I had any available funds for the reinstate loan, that I could raise funds for a Workout, if I had 401K to check for resources there, he asked if I still wanted to keep my house.

February 16, 2006 - Work 2nd telephone call

Tim - Countrywide - stated DO NOT FAX anything that the investor do NOT have a loan modification or work out plan for me. Can no longer help me with a workout program.

I just listened, I didn't know what to say....

Tim stated that I need to increase my salary to be fully reinstated and to get monies for as much possible for past due payments. If I had any equity I can restart a fresh beginnging, however, to have a repayment plan for 4-12 weeks, doubling payments.

I asked Tim why this was not mentioned before with Andrea, Cecil and Melissa and he stated that rep I spoke with on January 29, 2007 was in a training period and he would let her supervisor know.

MY SCENERIO.....

I am exhausted, confused, infuriated, lost, depressed and feel that life has been sucked from me. I am a single mother who has children and a grandchild, we help others that need help and would give our shirts off our backs. How can Countrywide do this to me and my family.

Many lawyers and judges have assumed that if a mortgage company foreclosure on you, that money is owed. But, with recent problems concerning this same problem, I do have a valid defense.

I have NOT put myself in this situation, I paid monthly, NO missed payments (stated) nor was I behind. I have a mortgage obligation and I contain to that policy. I have done everything and my house is wrongfully being foreclosed.

I want to be treated fairly.

I am so uptight, my neck is killing me. Thank you for your response. Since my initial posting, I emailed ALL I could, Comptroller of the Currency, Office of the Ombudsman, Dept. of Treasury, BBB, FTC, HUD Office, TN-Senators, TN-Congressmen, Hiliary Clinton, The View, Erin Brochovich, and including the President/VP of the US. I have had many replies instructing me on what to do, and I have complied, yet I am nervous since I spoke with Countrywide last (2/27/07) they want 4,607.95 from me to be reinstated by March 2, 2007, after that the amount accumulates. I was informed by them that my house will foreclose April 17, 2007. I am helpless right now. I have so many, many conflicting stories from Countrywide it isn't funny, yet they are not willing to help me. When Countrywide calls they have the audacity to ask me if they can be of any services, yet none can be given and to have a nice day. The collection calls continues. I have pleaded for help to all listed above. I had my daughter-in-laws (who are very mathematically skilled)and one who works at a bank take my statements to a loan officer - it took two days for her to decipher those and then could not figure out what was being done. What else can I do? I do appreciate your response. Keep me in your prayers as I do those who have been inflicted by the same situation.

First calm yourself down. They want you to become distressed. Countrywide is famous for this behavior. First make a copy of your report you placed here. Get all your checks, receipts, statements from countrywide. Every letter they sent you. They had to mail a letter of default(certified)Did you get one? Gather your mortgage papers together as well. Loan docs. Demand again your file from them. They only have so many days to comply. Immediatly contact your local dept of commerce and your attorny general. Make copies of eveything you have and send it to them. I personally brought them to their offices. You can download the complaint forms from both depts.Be sure to let them know they are forclosing on you. You may even be able to put a restraining order on them to stop the process. Inform Countrywide of your contact with these depts and let them know they are in for a ride. Don't believe what some are saying that you won't get help from them. It's their job to protect consumers Put all your payments in an escrow account. Countrywide has to prove themselves. they have to account for every charge they trump up. Don't be stupid and file bankrupcy to save your home. There is so much to say. Don't back down. Write your local congressman, senators demanding something be done. They are a evil entity running amok, as all sublime lenders and brokers are. Please write a update. Everything will be alright.
