I am dealing with a similar situation with CountryWide Mortgage. I had signed up to have my mortgage payments deducted from my checking account bimonthly. They deductions stopped in May and when I called to inquire as to the reason; first I was told there was a glitch in the system and the deductions would come out in June.

June came and no deductions. I called to inquire and was told there was no payment due and the deductions would start again when a payment was due.

I received a letter from Countrywide on July 16, 2004 stating I needed to call and "reactivate my pay plan26". I called in that same day CountryWide and advised them that I wanted to reactivate my payplan per a letter I received and was told that they do not reactivate the payplan26 and that I needed to reapply (another fee). Then I was advised that I could not even do that because my payments were 2 months past due. I am now 3 months past due because the mortgage company will not accept my payments and are threatening foreclosure. CountryWide is also charging me late fees and reporting this to the Credit Bureau!!!

I am receiving letter after letter from them requesting money from $1300 to now $1800 plus late fees. I contacted CountryWide again, via a letter I received from them stating I could contact them to refinance. I did this and was advised that because my payments were behind, I they could not refinance me. It is a vicious circle with these people. They mailed a "Financial Information Sheet in July, which I completed and returned promptly on July 28, 2004. I called, they do not have it. I faxed it to them, I called..they do not have it. On top of all this, these people act like I am a bum who just doesn't pay bills.

This is a mortgage company that services loans for HUD, which happens to be a federal agency. HUD is responding to me like it is no big deal. What about restitution for me. My credit is ruined and I may lose my home over this. If you think I am not furious, think again. I have contacted different attorneys but no one wants to get involved. Everyone just wants to take the opinion that the Mortgage Company is probably right and I just don't want to pay my bills. I had an excellent payment record with these people before this! I am furious!!!!

I can't even get anyone to acknowledge that this is wrong. THe sad thing isthat even Countrywide acknowledges that the customer service reps have noted the system that I called and inquired about the payments and what I was told me.

Since they have now added to the ruin of my credit, I believe I should have restitution.

I hope that someone will come to my aide.
