There are a lot of complaints about that company on this site. Your situation sounds like classic predatory lending tactics. It isn't "by accident". Predatory lenders do things like that on purpose to keep you a captive of their less attractive loan products. You can't re-finance now because they screwed up your account, and they won't fix it. They are hoping you eventually get tired and give up. This ends up making them more profit at your expense. Look up your rights by doing a search under "predatory lending" and "fair credit reporting act" and also "truth in lending". If you are Hispanic, you also fall under a protected class in the HUD guidelines, and you might have grounds for a discriminatory complaint through HUD. Go to the HUD website for more information, I think it's www.hud.gov. If HUD finds a pattern of abuse by the lender, the matter gets referred to the Department of Justice for follow up. HUD makes the company answer to your complaint. Also, the bank regulators for the company (the regulators vary depending on whether the bank is state, national, etc--you can research the regulators on line also) are very good (but it's slow going). I filed a case with HUD regarding a mortgage application. The case is still pending, but in the paperwork the company submitted in it's rebuttal to the regulators, proof of altered forms came out. When a company has to answer to the regulators for their actions, their sleaze often comes to light. Add your voice to the HUD files, and let them spin their wheels justifying their actions to their regulators. Good luck on your case!

If you want to call the President of Countrywide Home Loans, try calling (800) 669-6093, fax: (805)520-5032. Direct your complaints to Victoria Havens, Executive Research Specialist, Office of the President. You can also email your complaint/problems to Julie Martin as well, [email protected] and try to cc: [email protected] as well. Contact the Fair Trade Commission (FTC), contact the California Department of Corporations; the states licensing entity that oversees lender/mortgage companies such as Countrywide. This company is so disorganized they don't what they're doing, good-luck. Update your progress.
