This complaint is against Dell, Inc. and I feel that NBC should broadcast it to warn consumers of Dell's possible fraud tactics.

1st accusation: Failure of complying the terms in the order confirmation email, by not shipping out what I originally ordered. I ordered a computer + printer + LCDTV, but I did not receive the LCD TV or the Dell 720 Printer.

2nd accusation: Violation of FTC rules, including sections 238.1, 238.2, 238.4 ("Bait Advertising", "switch after sale") and 233.4 ("Bargain offers based upon the purchase of other merchandise.") Dell used a game online to allow coupons to be distributed and to gain business. I obtained a coupon online from someone else, and used it to make a purchase on Dell.com, therefore giving them my businesss. They took away the printer and LCD TV, therefore breaching the contract/invoice that I had paid.

3rd accusation: Violation of FTC rules on using the word "free" -- Free printer was supposed to be included with computer, but was canceled as well.

4th accusation: Intentionally canceling LCD TV orders right after computer was delivered. I received the computer on December 1st, then was notified of cancellation of the LCD TV only AFTERWARDS. This pattern of "Shipping out part of the system first" and then "canceling the TV" after the shipment was made has happened to many other customers as well, probably thousands of other customers.

5th accusation: Discrimination in the type of coupons which were cancelled. Many other coupons were so-called "illegally" obtained (e.g. 25% off flatpanels, 15% off accessories, etc via others clearly playing the game multiple times within one day), but the only ones in which the orders were cancelled were those involving the $1 LCD TV. This allows Dell to selectively use the game to draw in sales, but to selectively cancel orders that will not be cost-effective for them.

6th accusation: Dell states that I have to ship the computer back within 7 days for them to pay for it. Due to a situation that is clearly Dell's fault, I now have to ship the computer back, but will be unable to do so until later than that 7-day requirement. This is further unjust and immoral.

Backcharge.. It's normal Dell practice in the 4th quarter to inflate sales and then renege to improve margin. Happened several years in a row.

I am the same situation: 1. Dell never intended to ship these LCDs. They are on backorder till mid-January next year. 2. It's normal Dell practice in the 4th quarter to inflate sales and then renege to improve margin. Happened several years in a row. 3. The whole idea is based on the so-called "Prize winning scam" (check FTC website)to make people buy things they don't need and/or overpriced. 4. Customer service was given misleading information to get more people buy into this scam, they've been confirming validity of coupons and eligibility. What we need to do and what I am doing: 1. Actions under The Fair Credit Billing Act (FCBA- 15 U.S.C. Sec. 1666) shall commence immediately - billing error notice to credit card company for non-delivery of goods. Credit card company will backcharge Dell and let Dell try to collect amount from you and me. 2. Office of Attorney General of Texas shall be notified of violations of Texas Deceptive Trade Practices Act, Chapter 17 of Texas Business & Commerce Code, and as it directly relates to this issue in particular: Deceptive Advertising - Subchapter B, paragraph 17.12 (a) (1). Deceptive Trade Practices and Consumer Protection - Subchapter E, paragraph 17.46 (b) (9) and paragraph 17.45 (13). 3. Along with actions listed above complaints to FTC and BBB of Texas shal be submitted. 4. Let's keep pressure on them. All emails to Dell shall be sent via Customer Sevice to have return receipt and reference number. Thank you. Let's work on it together.
