We had a 2004 focus from dt and while still under my warranty it broke down (we had it for only 3 months) and needed lots of $$$$$$$$$ worth of repairs! The repair shop they sent us to submitted the repairs to dt and they were denied with no reason given the car sat there for 2 weeks while we made our payments and went back and forth with them. All of our payments were made on time but paying for the repairs and the payment due at the same time I just couldn't do it and had to give the car back to them. I was told that the warranty covered everything except for cosmetic damage but that was a huge lie! My credit went from a 699 to 416 from drivetime and now they are saying we owe them 10,000 dollars! I tried to contact them and get reports of the submittals for repair and they said they have no record of the car ever being in the shop and they had no idea it was ever out of order until we dropped it off to them! Coincidentally, when I called the repair shop to try and get something from them...they said "Sorry,we didn't do the repairs so we have no record of your car ever being here!" I want to get a lawyer this is just not right! Why should I be charged 10,000 for a car I would still be driving if they had honored thier warranty?

If you were making your payments on time and they forcibly took your car from you, I'm thinking that would be theft, or at least one helluva basis for a lawsuit. I'm thinking they did not use the first vehcile as a trade toward the second and the second toward the third though. If they would have done that in either instance, it would have made the loan amount too high on the next one you were getting. They probably sold you the second and third ones as additional vehicles and let you assume you were trading them for the next one. If that's the case, the blame might be on you for not paying attention.

It's was ruined before you met them, that is why you had to go do DT to get a car in the first place. Sounds like what they've done is took the cars in trade, and never payed off the previous loan. You need to get all your paperwork together and contact a lawyer, an attorney can better explain what happened better than anyone here, since we can't see your contracts. Also, you need to gather all your receipts and/or cancelled checks for the car payments, just to verify that you never missed a payment. If you have all this information, and it is absolutely as you describe, then you have a solid case for dealer fraud.
