I have been an e-bay seller since 2003. In most cases problems can be resolved with after many calls to customer service. This time however it is different.

The Rules have changed as of the 20th of this month and e-bay is holding cases that the SELLER WINS, against the seller.

If a customer chooses to not return the item, due to whatever reason, and the buyer closes a case, this is held against the seller. That is not fair and presents A LOT of problems for the seller.

I have 4 cases in my seller dashboard, as of the beginning of this month, ALL have been resolved, 2 via refunds and 2 via customers closing case due to not wanting to return the items. All of these cases are charged against me and under the new rules - after 14 years of successful selling, my seller performance is now below average, my credit cut off, and all my payments held until item has been delivered.

This is NOT my fault, this is a BUG in the e-bay system. If the case has been resolved it should NOT count against the seller.

The following items have closed cases that I won against the seller

201445878755 - DVD NOT returned, buyer flagged for fraud and e-bay and paypal accounts closed.

201487292774 - Watch, battery failed, customer had to replace, not my fault, it was working when shipped. Customer kept watch and closed case, refused to return item. Case closed by customer, so again I win.

201369711261 - Apple warranty - did not fit phone, customer bought without checking to see if would fit or not. Of course a 5 year old warranty will not fit a Iphone 6, duh.. customer refunded after returning... Customer remorse issue. Resold to different customer, no problems found.

Who is the bad person here, three cases, destroyed a 14 year history with company. I had a $70,000 per month selling limit, and about a 5,000 per month auction limit. All gone, due to a e-bay screw up.

Yes I would like to pursue legal action for fraud. Charging sellers for cases that are resolved is FRAUD, and should not be allowed. A letter to legal has already been mailed. Until then no more auctions for me. The ones I have will gradually time out and stuff will sell. But no new auctions will be listed until this problem is resolved.
